Suit: Paralyzed Man Dragged From Car and Beaten by Chicago Cops

A series of anecdotes aren't data, but these kinds of stories have been popping up every day for years ...

Chicago Sun-Times:

A quadriplegic man sued the Chicago Police Department in federal court Thursday, claiming officers yanked him out of the passenger seat of a car in 2006, dragged him to the ground and beat him up even though he kept yelling "I'm paralyzed."

"They were kicking me and punching me," Daniel Casares said. "I was scared for my life."

Casares, 28, can't use his legs and his right hand -- and his left arm and hand are "significantly paralyzed," said his attorney, Blake Horwitz.

On Oct. 9, 2006, Casares was a passenger in a car driven by his brother. They were parked in an alley in the 10300 block of Avenue M in the East Side neighborhood.

Casares said he was waiting for a man to bring him money for a car deal when officers approached. The cops suspected the men were smoking marijuana and told them to get out of the car, Horwitz said.

The cops were members of Chicago's Targeted Response Unit, "deployed across the city to fight crime in 'hot spots'," meaning poor, mostly minority neighborhoods, which is one reason why, in the country that locks up more of its citizens than any other on earth, criminal justice issues are often ignored by the majority.

Unfortunately, there's a lot we don't know from reading this article. Why did the cops suspect that these two brothers were smoking pot? Were clouds of smoke issuing forth from the car's windows a la Cheech and Chong flicks, or was it that they were a couple of Latinos sitting in a parked car? According to the Sun-Times, drug charges against the brother were later dropped, but that doesn't shed much light on the situation either way.

Casares told the officers at least four times that he was paralyzed, but they pulled him from the car and beat him anyway, Horwitz said.

Judge James Brown convicted Casares of resisting arrest, and he got a year of court supervision.

Officer Belinda Bernal, one of the seven officers Cesares is suing, said in an arrest report that Casares punched her in the left eye "causing redness and bruising." She changed her story at a bench trial, saying she was punched in the right side of the face, according to Horwitz.

The arrest report said the officers "used force reasonable to effect the arrest" of Casares and that he suffered "minor cuts to the head." Horwitz said his client suffered "12 to 15 cuts" on his face.

Before he was paralyzed, Casares was arrested at least six times but not convicted, records show.

Bernal isn't facing any other lawsuits, but three of her co-defendants have been sued in federal court for alleged police brutality, and the city has paid out settlements in some cases.

Another officer, William Cozzi, was recently charged with violating the civil rights of a man in a wheelchair. Cozzi was caught on a hospital security camera beating the drunk, unruly man.

Personally, I feel like a frog in a pot and it's getting warm in here.

Some of the comments over at the Sun-Times are telling:

"Stop rewarding people millions of dollars for putting themselves into bad situations..."

Parked in a car, paralyzed. He did ask for it.

"Here's a message to the police: Please stop making millionaires out of people at our expense. You cops might as well have a lottery machine set to 'win only mode' plugged into your squad cars. Quit lying about the facts and circumstances because all these people do is go out and buy a house in the suburbs, a fur coat, and a new caddilac."

Ah, there's the real problem: "these people" moving to the suburbs and buying fur coats and "caddilac." And, yes, I'll concede that getting beaten up by cops is much like winning the lottery.

"Looking at the accompanying photo, he has 'attitude' and before he was paralyzed, Casares was arrested at least six times but not convicted, records show. He has a track record, maybe a sleezy lawyer who wiggles him out of his jams and obviously the police knew this. He's a punk."

Obviously, the police used their super-duper-powers to determine that Casares had been arrested and then got off six times before they approached the car. And we all know that past arrests -- without convictions -- are exactly the same as probable cause. Being a "punk" with "attitude" is enough to justify police violence, never mind if the punk is paralyzed.

"Looking at the accompanying photo" pretty much tells you everything you need to know about where we are when it comes to race -- and class -- in America.

I lived in Chicago from 1971 to 1980 and stories of unfettered police brutality were rampant, even back then.

But the Chicago Police is not an exception. The same situation exists in New York (now, and when I lived there from 1980 to 1982) and other cities large and small across America.

What else can you expect when a barely trained, poorly supervised, group of armed thugs in uniform are given free rein to think that they can do what they want, to whomever they want, especially if the "perp" happens to have a skin color other than pure, pure, Ivory snow white.

Question: Much of Corporate America gives new employees psychological screening to weed out potential trouble-makers. Why isn't this done by police departments?

THey used all the violence and brutality needed to make an arrest of a resisting suspect..... who is a quadraplegic with partial use of ONE.. count them.. ONE limb! And, of course, he gets busted for "resisting arrest" with his one partially functional limb.

Makes total sense.

Demonstrated nicely. It was probably hard to find 3 jerks with internet access in a country of 300M.

Otherwise, it is important to let justice play out. This case sounds very, very nasty. Hopefully, the beaten will get justice if the facts at trial support his arguments.

ENDLESS INVESTIGATION IN NEW JERSEY

On June 26 a 21 yr. old was shot 5 times by a policeman. He's dead. It's still being investigated. In the meantime things are very quiet. A routine traffic stop they're calling it. There was a video and they've quesitoned 70 people. The boy had no gun. By all accounts he was a decent kid. It's been a month. That's enough time to figure it out. So, it's not looking good for the cop. Can't imagine why. ANNA

Why were they waiting in an alley to pick up money? What time did this take place? Is there a police video of what took place? What were the charges in the six previous arrests? Why was he not convicted? How did he become paralyzed? Is he hispanic? Oh, never mind, I just noticed the poster's name. What is his immigration status?

When the top officials of this country ignore Constitutional, domestic, and international laws, police brutality, which has always been a severe problem in this country, is going to get worse and worse.
What this nation truly needs is a new, in-depth, independent (with both Congressional and citizen oversight) of the events of 9/11/01.
We still do not know what really happened. For instance, the 9/11 Commission doesn't even mention WTC building 7, which collapsed at around 5 that evening, without having been hit by anything. It had fires on about 4 floors, but was farther away than other buildings which were much closer, yet remained fine.
Furthermore, there is overwhelming evidence that Police Officers, Fire Fighters, and reporters not only knew the building was going to collapse, but at exactly what time. There's also a TV interview with Larry Silverstein, who said they "pulled" the building and then "watched it collapse" after receiving a message from the Fire Dept. Commander expressing concern about containing the fires.
So why did they change the story?
Maybe because it usually takes a week to rig a building of that size for wireless demolition, and could not have been done on the day of the attacks; which means, if it was "pulled"--and there's really no other explanation for its collapse--that it had to have been set for demolition prior to 9/11!
Never in the history of steel-framed buildings has one collapsed from fire,even like a recent one in Madrid where fires raged for 18 hours,completely gutting the inside of the building. Yet, the steel frame remained standing.
All these policies that have been pushed through, which would never have been considered before, have been done by manipulating the fear generated by this event. The administration did not want an investigation, and only relented under public pressure generated largely by 3 widows of this tradgedy often called "The Jersey Girls."
The crime scene was violated, despite the fact that Mayor Guiliani was a former prosecutor and knew that it was a Federal crime to destroy evidence. Yet, almost all of the steel recovered from the WTC buildings was shipped all the way to China and melted down. Steel is not cheap. And careful inspection of this steel could have told investigators a great deal why all three buildings collapsed, straight down, at near free-fall speed, including WTC 7 which was not even struck by anything. The Towers were designed to withstand multiple impacts from jumbo jets, which at the time were only slighly smaller than the ones that hit it, but these older planes actually had a higher speed which would make up or even exceed the impact caused by the slightly larger planes that hit. Besides, as I said, these buildings were designed to withstand multiple impacts.
In fact, anyone who truly researches the "official" report will find holes in it big enough to fly one of those 757s through.
I do not claim to know what happened; but I have no doubt that the truth has been covered up and distorted, and there is clear evidence that the White House did everything in its power to prevent a real investigation.
Like, why didn't the president and vice-president not agree to speak to the 9/11 Commission under oath, and seperately? They only agreed to do it together, and not under oath.
I think it is vital that we get to the bottom of this tradgedy and find the truth, since our very Constitution has been severely altered due to legislation pushed through using the fear and insecurity generated by this event.
It is especially chilling to think that the neo-cons, in their manifesto, "Rebuilding America's Defenses," stated that getting the legislation they wanted passed, as well as the ability to pre-emtively strike Iraq and other targets, would be difficult to get passed, in the "absence of some catalyzing event, like a new Pearl Harbor."

Sorry about the fact that I constantly incorrectly spelled the word "Tragedy" in my previous post. I don't know why I thought there was a "D" in there.
While I have some space left, let me point out another problem I've always had with this whole business.
Before I do that, let me also say that the other agency that investigated the events of 9/11, NIST (National Institute of Standards and Technology") said, concerning the collapse of WTC 7, that their best hypothesis for its collapse--fire--had only a very minimal probability of occurence. At least they didn't just completely ignore it, like the 9/11 Commission did. It's also interesting to note that, despite having already benefitted immensely from this tragedy (due to having taken out a huge insurance policy covering acts of terrorism) that Larry Silverstein tried to collect even more money by claiming that each building represented a seperate act of terrorism. He was denied this.
Now, it's interesting to note that WTC 7 contained offices of just about every government agency there is within the U.S., including the SEC, where was kept the bulk of evidence against Enron and other corporate crimes of a similar nature.
Finally, even more disturbing is all the "put-options" placed on United and American airlines in the weeks and days before 9/11, which generated enormous amounts of money. One account contains something like 2.5 million dollars, and has been left unclaimed.
Due to security policies, the names of those who benefitted from this tragedy, and who holds the account of the unclaimed money,are protected. Congress could, however, subpeona this information, but has not done so, which I find extremely bizzare and perhaps indicative of either involvement or a cover-up.
Another big hole in the official story results from the anaylsis of the black box from the plane that supposedly hit the Pentagon. Professional pilots have said, after analyzing this data, that it would not have been possible for the plane to have severed the light poles we've been told it did. Which could only mean...well, you decide for youselves, but I recommend checking out the Pilots for Truth website.
