Conservatives Want Bush to Issue "Pre-Emptive Pardons" to Officials Involved in Illegal Programs

The New York Times reported this weekend that “[f]elons are asking President Bush for pardons and commutations at historic levels as he nears his final months in office, a time when many other presidents have granted a flurry of clemency requests.” However the Times noted that despite commuting Scooter Libby’s prison sentence, applicants “should expect to be disappointed” because Bush “has made little use of his clemency power” compared to past presidents.

Except perhaps if you participated in any illegal activity involving the Bush administration’s controversial counterterrorism programs. According to the Times, “several members of the conservative legal community” in Washington D.C. are urging Bush to issue “pre-emptive pardons” to those involved so as to “not be exposed even to the risk of an investigation and expensive legal bills”:

Such a pardon would reduce the risk that a future administration might undertake a criminal investigation of operatives or policy makers involved in programs that administration lawyers have said were legal but that critics say violated laws regarding torture and surveillance.

Some legal analysts said Mr. Bush might be reluctant to issue such pardons because they could be construed as an implicit admission of guilt. […]

“The president should pre-empt any long-term investigations,” said Victoria Toensing, who was a Justice Department counterterrorism official in the Reagan administration. “If we don't protect these people who are proceeding in good faith, no one will ever take chances.”

Stuart Taylor, Jr., a constitutional law fellow at Brookings, agrees, saying in a recent Newsweek column that investigations into the Bush administration’s “high level ‘war crimes’” are a “bad idea” and instead called for a “truth commission“:

A criminal investigation would only hinder efforts to determine the truth, and preclude any apologies. It would spur those who know the most to take the Fifth. Any prosecutions would also touch off years of partisan warfare. […]

Absent pardons, pressure to go after GOP “war criminals” would make it very hard to unite Americans of all stripes behind solutions to the many economic and social challenges facing the country.

In fact, the conservative D.C. lawyer circuit may just get its wish. The White House “would not say whether the administration was considering pre-emptive pardons, nor whether it would rule them out.” (HT: Dan Froomkin)

It should be stressed that this wasn't a loud boisterous march like Monday's, but just a crowd of 100 people walking calmly down the street.

OF COURSE Bush will pardon many, if not all, of those involved in torture and other sadistic nastiness.

George Bush, a man-demon hybrid, takes care of his own, you know.

And in any case, even if the president didn't pardon anybody, no one will be investigated and/or prosecuted anyway. Who is going to order investigations? Congress? (Ha!) The Justice Dept under Bush? (Double Ha!) The Justice Dept under McCain or Obama? (Har Har!)

Too bad the World Court seems to be afraid of the US. (They don't want to seem "political", now, now.)

And the pundits wonder why Americans are so angry!

Right, what good would a Criminal Cabal be if it could no longer Protect its Co-Conspirators? I mean these Criminals are just obedient Lawyers and Highly Connected defense contractors and the like, with duel citizenship and shadows in the depths of international intelligence communities who would never have means, motive or opportunity to commit self-enriching crimes, right?

Bush, December 2001, "and never let us tolerate outrageous conspiracy theories which seek to shift blame away from" the "sand-ni**ers" (phrase on loan from Iraq War veterans who've returned) standing in the way of our goddamn Afghan Pipeline and US Oil located in Iraq and Iran!

Pardons for all Bush War Criminals, and 3 more cheers for Co-Conspirator Cover Ups, White Washes and Truth Commissions!!! Fascists Win!!!

Have a Nice Armageddon... Peace on Mars.

The Pardons will fly like Starlings..

I knew this was coming and have no doubt that Bush will comply...

This is why those who argued that Obama would pursue the Telecoms criminally were once again so easily mislead or misdirected...

I imagine we are going to see pardons flying like those Starlings in England and I am sure John Yoo David Addington and our Attorney General Mukasey and Alberto Goonzales will all be lining up for their own before things and this administration is over...

To Pardon The Neo-Con Infrastructure Is Typical

As a black male, we as an entire ethnicity {so-called 'race'}, were expected to speak out against criminals in the black community such as "O'Jay", and yet the Jewish community can hide behind "anti-semitism" and avoid being judged by the U.S. mass media for not having expressed outrage over the Neo-Con's activities.

MILLIONS of people have been MURDERED in Iraq and untold numbers in Afghanistan, naturally this has not quenched the thirst for blood of these people as they are looking to pre-emptively strike Iran if they can not STARVE the people there to DEATH by sanctions!

Where are the "sanctions" against Israel?

It was the Neo-Con movement that pushed this agenda and the majority of Bush Administration officials are Neo-Cons with DUAL Israel, U.S. citizenship. Where is the "outrage" over this from the Jewish community? Where is the public outrage and expression of disgust against the Jewish community or charges that they have done nothing to address this horrid affair? As the mass media attacked the black community for YEARS and YEARS over O'Jay?

Information regarding the Neo-Con movement and dual citizenships along with its principle players in the Bush Administration have been known for YEARS and YEARS!

Most can name only a few people of Jewish faith who have even bothered to speak out in public against this administration such as: Dr. Noam Chomsky, Norman Finkleman, Naomi Klein {if memory serves me correct} and perhaps a miniscule amount of others.

Estimates are that over 50 million Africans died on Slave ships in route to this country, and yet slavery is not used as an excuse when black people, most especially black males commit "crimes!" Yet documentaries of the Holocaust and expressions of the need to "understand" the Palestinian conflict and Israel's "right to exist," are shoved down the throats and minds of Americans on a daily basis!

WRONG is WRONG! There is no justification to not prosecute the Neo-Cons, AIPAC,lobbyists and their entire infrastructure, but also the journalist, news organizations, NGOs, Military officials, the criminal Rothschild family and their cohorts, but all others connected with them!

Richard Pryor said it right years ago in that when "we" referring to the establishment as it exists here, says "justice," they mean JUST US!

Terrific

Is a premptive pardon legal?
Posted by: SteveO on Jul 22, 2008 12:34 PM
Current rating: 5    [1 = poor; 5 = excellent]
Artical II reads "he shall have Power to grant Reprieves and Pardons for Offences against the United States, except in Cases of Impeachment."

Doesn't there have to be some sort of accusation made before there can be a pardon? Additionally, can the president pardon himself?

The simple solution: When they plead the fifth, waterboard them.

Who needs a bothersome Constitution and limiting laws, when we have the Bush regime, a corporate Congress and a Zionist Attorney General to protect us.

The Biggest Criminals Get Away With Their Crimes

This is the whole plan. Before he leaves office Bush will have the mother of all pardons. He will pardon anyone who ever got close to the White House during his Presidency.

Thus, the criminals of the last eight years will get off without any punishment, safe in their new corporate jobs to pay them off for their service.

Even if the perps are allowed to commit obvious crimes and then are "pardoned," they will never be able to stop committing further crimes.

All we need to do is watch for it to happen and then keep publishing the truth.

Truth or Consequences?

Truth and Reconciliation Committees generally require confession before forgiveness so if we want the truth about torture and wiretapping etc this might be the way to go. If we want punishment we could ship BARRCFAYG (prime suspects Bush, Ashcroft, Rumsfeld, Rice, Cheney, Feith, Addington, Yoo and Gonzales) to international tribunal in the Hague for war crimes but this will never ever happen. We could ship BARRCFAYG to Guantanamo for six years of detention without trial using the alternative interrogation techniques they approved: simulated drowning, sleep deprivation sensory deprivation and stress positions; this also will never happen. I doubt high level US officials will ever punished so maybe full confessions from a Truth and reconciliation is a good idea but no confession, no pardon.

AlwaysAskWHY - Fear Mongering

Just more fear mongering and blackmail, the currency of Congress:

"Absent pardons, pressure to go after GOP “war criminals” would make it very hard to unite Americans of all stripes behind solutions to the many economic and social challenges facing the country."

THIS IS A NATION OF LAWS! Just throw their butts in jail and let the chips fall where they may!

Whoever stands up AGAINST prosecution of criminals indicts themselves as conspirators and accomplices.... AS NANCY PELOSI AND THE DEMOCRATS HAVE ALREADY.

* A WAR-FOR-PROFIT IS MASS-MURDER - A CAPITAL OFFENSE/CRIME!
* TORTURE IS A WAR CRIME!
* ILLEGAL SURVEILLANCE IS A CRIME!
* OUTING A CIA AGENT IS TREASON!
* LOOTING IS A CRIME!
* NO-BID CONTRACTS IS AGAINST THE LAW!
* BLOWING UP 3,000 HUMAN BEINGS ON 9/11 WAS BUSH'S, CHENEY'S AND THE NEO-CONS' REICHSTADT... AND WAS A HORRIFIC CRIME!

AND PRESIDENTIAL LIES ARE A CRIME AGAINST OUR CONSTITUTION!

Perhaps we should just WASH THE BLOOD FROM THE WHITE HOUSE AND CONGRESS... VOTE OUT ALL incumbents.

Maybe then we will get justice...and then...maybe not, but it's worth a shot.
