Bombshell: Rep. Jane Harman Caught on Tape Agreeing to Lobby for Alleged AIPAC/Israel Spies?

This is a huge story: Representative Jane Harman, a hawkish, influential “Blue Dog” Democrat “was overheard on an NSA wiretap telling a suspected Israeli agent that she would lobby the Justice Department reduce espionage-related charges against two officials of the American Israeli Public Affairs Committee, the most powerful pro-Israel organization in Washington,” according to a report from CQ Politics:

Harman was recorded saying she would “waddle into” the AIPAC case “if you think it’ll make a difference,” according to two former senior national security officials familiar with the NSA transcript.
In exchange for Harman’s help, the sources said, the suspected Israeli agent pledged to help lobby Nancy Pelosi, D-Calif., then-House minority leader, to appoint Harman chair of the Intelligence Committee after the 2006 elections, which the Democrats were heavily favored to win.
Seemingly wary of what she had just agreed to, according to an official who read the NSA transcript, Harman hung up after saying, “This conversation doesn’t exist.”

The case, known as the AIPAC espionage scandal centers around allegations that at least two AIPAC staff members passed sensitive US intelligence on Iran, provided by Pentagon official Lawrence Franklin, to Israel. In early 2006, Franklin pled guilty to espionage-related charges and was sentenced to 13 years in prison. The case against two indicted AIPAC staffers, Steve Rosen and Keith Weissman, is ongoing.

Allegations that Harman intervened in this case in an effort to win the spot as chair of the Intelligence Committee have been widespread since 2006, but an FBI investigation into Harman was dropped for “lack of evidence.” As CQ Politics reports:

What is new is that Harman is said to have been picked up on a court-approved NSA tap directed at alleged Israel covert action operations in Washington.

And that, contrary to reports that the Harman investigation was dropped for “lack of evidence,” it was Alberto R. Gonzales, President Bush’s top counsel and then attorney general, who intervened to stop the Harman probe.

Why? Because, according to three top former national security officials, Gonzales wanted Harman to be able to help defend the administration’s warrantless wiretapping program, which was about break in The New York Times and engulf the White House.

When Justice Department officials reviewed the transcript of the wiretaps on Rep. Harman, its attorneys determined she had committed a “completed crime,” which, according to CQ Politics is “a legal term meaning that there was evidence that she had attempted to complete it.” The Justice Department attorneys wanted to open a case on her, but they needed the green light from top intel officials to confirm it rightly constituted a national security investigation. Porter Goss, who was then the CIA director reportedly approved the investigation and was preparing to notify then-Minority Leader Nancy Pelosi and House Speaker Dennis Hastert and, through them, Harman herself:

But that’s when, according to knowledgeable officials, Attorney General Gonzales intervened.

According to two officials privy to the events, Gonzales said he “needed Jane” to help support the administration’s warrantless wiretapping program, which was about to be exposed by the New York Times.

Harman, he told Goss, had helped persuade the newspaper to hold the wiretap story before, on the eve of the 2004 elections. And although it was too late to stop the Times from publishing now, she could be counted on again to help defend the program

He was right.

On Dec. 21, 2005, in the midst of a firestorm of criticism about the wiretaps, Harman issued a statement defending the operation and slamming the Times, saying, “I believe it essential to U.S. national security, and that its disclosure has damaged critical intelligence capabilities.”

Pelosi and Hastert never did get the briefing.

And thanks to grateful Bush administration officials, the investigation of Harman was effectively dead.

On his Salon blog today Glenn Greenwald points out:

Jane Harman, in the wake of the NSA scandal, became probably the most crucial defender of the Bush warrantless eavesdropping program, using her status as “the ranking Democratic on the House intelligence committee” to repeatedly praise the NSA program as “essential to U.S. national security” and “both necessary and legal.”  She even went on Meet the Press to defend the program along with GOP Sen. Pat Roberts and Rep. Pete Hoekstra, and she even strongly suggested that the whistleblowers who exposed the lawbreaking and perhaps even the New York Times (but not Bush officials) should be criminally investigated, saying she “deplored the leak,” that “it is tragic that a lot of our capability is now across the pages of the newspapers,” and that the whistleblowers were “despicable.”  And Eric Lichtblau himself described how Harman, in 2004, attempted very aggressively to convince him not to write about the NSA program.

There may be some who attempt to portray Harman as a victim of blackmail by Gonzales (and the wiretapping of members of Congress—and other Americans— should be thoroughly investigated) but Harman is a right wing Democrat who was often in sync with the heinous policies of the Bush administration. Over at TalkingPointsMemo, Josh Marshall raises some interesting issues on this story, particularly relating to the wiretap itself:

Among the many questions the story raises are some that Harman should probably answer, but not all. High on my list would be finding out more about the circumstances under which a member of Congress ended up having her phone conversations recorded by the NSA. The article suggests it was a by-the-books wiretap — part of a highly-classified probe of Israeli agents in the US, which led to the indictments of two AIPAC employees — and not one of the ‘warrantless’ ones. But we’ve seen so much funny business on that front that I’m not sure that’s enough information.

In a prepared statement, Harman said: “These claims are an outrageous and recycled canard, and have no basis in fact… I never engaged in any such activity. Those who are peddling these false accusations should be ashamed of themselves.”

Harman was, I remind you, also the main sponsor of HR 1955, the Violent Radicalization and Homegrown Terrorism Prevention Act of 2007.

Why does California produce such right-wing Democrats, such as Harman, Pelosi, and Feinstein?

Interestingly, given that we here on Alternet have made the point that most Democrats (including the current president) -- Democrats who continually supported domestic spying, the 2 wars, and torture, while at the same time opposing habeas corpus and impeachment of Bush administration officials -- probably had some dirt on them that Republicans and Bush administration officials were using to blackmail the Democrats.
Well, now it seems (But is anyone surprised?) that that dirt was that the Democrats were in fact acting as agents for AIPAC and the Israeli government, against America's best interests.

Let's see if this story is reported in the MSM. Let me guess, not as much as the story about President Obama lowering his head to the Saudi king.
(The MSM doesn't want to look "antisemitic", now now.)

Not to diminish Pelosi's and Rockefeller's criminal facilitation in covering up torture and false reasons for war in Iraq, but Harmon here is revealed as AIPAC's Puppet in clear defiance of Oath of Office and the US Constitution.

As QQOblivion mentions above, Harmon was the prime mover of HR1955/59 which seeks to criminalize you and me for thought-crimes while Harmon and the rest of the blue-dogs cleanse their own and AIPAC's crimes against the people. Closely related is Emanuel's success in the White House of securing a get-out-of-jail-free card for Bush Torturers.

Harmon is batting 1000 for Above -the-Law-AIPAC-PNAC, criminalizing 911truth and Sibel Edmonds, protecting rogue nuclear traders, funding wars and mass-destruction and Crimes Against Humanity, illegal domestic spying, torture and rendition... Who needs external enemies when we have Jane Harmon?

was instrumental in sabotaging the nomination of Chas Freeman to the chairman of NIC.

Think about it. Rosen, an indicted traitor, has the power to decide who gets to decide major intelligence issues facing this nation.

And now Jane Harman scandal?

If it wasn't apparent until now, it should be obvious to even the most gullible among us: The US government is a serf to special interests, both foreign and domestic. And we have no say whatsoever in the policy decisions of our rulers.

So, what else is new? BTW Opposing AIPAC and criticizing the actions of the Israeli government does not an anti-Semite make, any more than criticizing our own government makes progressives "unpatriotic".

IMO, the Blue Dog Democrats should come clean and admit they're Republicrats. That's why I contribute to individual candidates and causes and not to the DSCC or the DCCC, no matter who they get to sign their fundraising letters.

If I wrote this article, it would have been called "Why I joined the Green Party". In short, I got tired of supporting criminals: ones who break laws like the FISA law are just as much of a criminal as the guy who breaks into your house and steals your electronics. They may be worse - they are PAID by us, to represent us, and they face little or no repercussions for their illegal actions.

When it was revealed in late 2005 that Bush had authorized secret wiretapping en masse of Americans in violation of FISA, Harman was only lukewarm in her dissent. She should have called for Impeachment hearings, otherwise what do we have laws for?

The Lunatics are running the asylum, people. This is an outrage. I hope the people in Venice, Redondo Beach, Torrance, El Segundo, and the rest of her district PAY ATTENTION TO THIS and either begin an immediate recall, or put up another democrat to face her in the primary in 2010. This is INSANE.

Will Eric Holder's Justice Department begin an immediate inquiry? How about the Intelligence Committee? How much cover are they all willing to give her?

I'm disgusted.

Who were the people behind Jane Harman introducing "The Violent Radicalization and Homegrown Terrorism Prevention Act?" This bill might again be introduced.

The Act" while not written exactly like the Nazi 1933 Discriminatory Decrees that suspended the Reich Constitution, had the potential of bringing America to the same place trashing America’s civil liberties. Harman’s bill would have driven lawful political activists underground, perhaps creating the domestic terrorists Bush said we needed to be protected from. Under Harman’s bill HR 1955, Americans could be alleged without evidence by government to support domestic terrorism based on their speech, writings and association. Similarly on February 28, 1933 Hitler signed the Discriminatory Decrees banning free speech and association that “might cause” public disturbance or adversely affect the peace and security of the German State—according to police.

Harman's "Violent Radicalization and Homegrown Terrorism Prevention Act" when closely examined, defined "homegrown terrorism" as "any planned act" that might use force to coerce the U.S. Government or its people to promote or accomplish a "political or social objective." No force had to occur. Government would only have to allege an individual or group thought about using force.

Had Jane Harman’s bill passed in its present form, police provocateurs could easily have destroyed lawful anti-war groups, persons and organizations by simply misdirecting a few members to commit crimes so government could allege an entire organization supported homegrown terrorism.

It is time for the Democratic Party to after the Blue Dogs. Blue Dogs are really Repugthugs who infiltrate the Dem Party and keep skewing Congress and the Senate to the right of center. The Dems need to run these dogs out in the primaries by supporting more progressive candidates. Let's run Harmon out of Congress in the primaries

Ironies of Sweet Ironies. As a liberal southern Democrat I love the irony of a woman who I used to respect very much and then after 9-11 she went right off the cliff with the rest of the maniacs. Harman helped write some legislation about a Domestic Terrorism Act in effect creating tribunals regionally to literally try the malcontents, the dissidents in actual courts outside the legal system using detention centers to jail legal American citizens these psychos deem a "threat" to "American Values." We really haven't progessed very far at all. How do you think the Oil Plantation is panning out? Now they got Afraid Jane on tape influence peddling. Ironic baby, just flat ironic. Send ole Jane up the river I say and all your racist, terrified, spying, oil stealing parasites. Nineteen Saudis attacked us and never forget it. Republicans overthrew Iraq to privatize its oil. Period. Bye bye Jane. Harman is the exact reason Americans are detested around the planet, the self righteous holier than thou, I shall chemically bomb you for your betterment and suck your oil dry for Jesus. Insane Jane. If you just tell the truth and do the right thing, like holding those who actually attacked us accountable for their actions then imagine all the drama and 1.3 million dead Iraqis we could have avoided. are criminals and should be prosecuted. Unless the case was compromised by Gonzales, I don't see why she can't be charged. Even if this news doesn't get out on the mainstream media, I don't see how she's gonna keep this one quiet. Her career is toast.

Or will CNN sweep this under the carpet , as they and the rest of the useless cable & networks do , when it comes to Israel spying on the U.S. or being involved in other crimes .

Damn this is great , they also ( Israel ) supply the NSA w/ their wire tapping equipment , through a company called COMVERSE . And if you don't feel insecure enough , AMDOCS ( Israeli Company) controls most of the directory assistance in the whole United States , as well as credit reports .

Throw in some Israeli firsters like Harmon and you know controls a large part of this government and country .

Waht has happened to the Republican party over the last 3 decades, is exactly what has been happening within the Dem party. There are factions with in both that work solely for the benefit or the Corps, not US.

Unfortunately the 3rd party supporters don't see the bastardization happening in their parties yet. Nadar? What the hell has he done in the last 3 decades- except steal votes away from Dem Candidates, thus effectively handing the 'win' to the Repug. And Barr?!? Are you Fucking Kidding me? he was so mezmerized by a Blow job, he couldn't think straight the last time he held office. Paul? He may know medicine- but Economics and World affairs is questionable. Not to mention the lack of 'infringement ' Cries from Paul about the use of his 'trademark' Tea party idea- he couldn't say anything because the Repugs helped fund his candidacy to begin with.al he had to say was "legalize pot" and he had the Left eating out of his hand- deaf to every other clearly Repug policy stance. FYI,3rd party candidates are Propped up Spoilers. Why do you think you hear so many Repugs claiming that there may be a new wave towards third parties- it's their Subsidiary anyway!
Actually I think there are still some honorable Public Servants in the Republican party and the Dem Party.. but they are few and far between. And who's fault is that, voters?

all of this is, no matter how much evidence there is against any elected person, nothing will happen.
The US has become a joke in the eyes of the world. I am sure the leaders of the world are laughing while watching everyone from the president down prove themselves to be nothing more then fools. No need for Iran, China or any other country to invade the US. They know it is just a matter of time and our elected (choke) leader will destory the us. The rest of the world knows the truth, Israel controls our puppet goverment. This bitch and anyone involved should be shot for betraying our country, but I won't hold my breath. I think I am going to spend my time learning Chinese.

S.1959: Government Planned Disruption of Lawful Activities

U.S. Government officials have called lawful protesters potential terrorists and a threat to national security.

Jane Harman’s bill HR1955, “The Violent Radicalization and Homegrown Terrorism Prevention Act" would have created a powerful “new government commission” to study, investigate and report to U.S. Government which Americans and organizations were “idealistically based toward Violence”, might or do support "Violent Radicalization; or Homegrown Terrorism. Evidence and other information collected by the “Commission” would have been shared by Government with law enforcement and to label certain Americans and others as “promoters” of homegrown terrorism, ideologically based violence and violent radicalization. Because this information would be “classified” lawful Americans and permanent residents—would never be able to refute terrorist labels made against them by government "commission investigators." The “new Commission” would have provided secret reports titled, “findings and recommendations” to Congress and the President. The Nazi Government used similar reporting commissions to discourage political dissent and to stop free association.

Subsequently the U.S. Senate amended its version of the “The Violent Radicalization and Homegrown Terrorism Prevention Act S.1959 with “Subtitle (J) Prevention of Violent Radicalization and Homegrown Terrorism.” The Amendment removed Constitutional and civil rights protections for permanent immigrants and U.S. Citizens. Subtitle (J) Sec. 899b used the weak words “should not” violate the constitutional rights, civil rights, or civil liberties of United States citizens and lawful permanent residents. The words “should not” were not binding legally on the Government. The Senate should have used legally stronger words, e.g., “Shall Not” violate the constitutional rights, civil rights, or civil liberties of United States citizens and lawful permanent residents.

See S.1959: “Government Planned Disruption of Activities.” S.1959 stated it would establish university based study programs to find “immediate and long-term countermeasures to violent radicalization, homegrown terrorism, and ideologically based violence…” While that sounded positive, S.1959 also stated its study programs would “conduct classified studies and make recommendations” for “Disruption.” ”S.1959 failed to explain how U.S. Government might “disrupt Ideologically Based Violence” when no crimes had been committed. The text in S.1959’s B) ANNEX effectively stated—reports submitted under subparagraph (A) may include a “classified annex” with recommendations on the feasibility to be administered by the Secretary for the purpose of preventing, disrupting, and mitigating the effects of violent radicalization, homegrown terrorism, and ideologically based violence if such a program is feasible.
