Gay Marriage Ban on California Ballot

California voters will have a chance to overturn the recent state Supreme Court decision to legalize gay marriage just five months from now, as the secretary of state certified a measure to define marriage as "between a man and a woman" for the November ballot.

Proponents of the measure submitted more than 1.1 million signatures to qualify for the general election ballot. A random sampling by the secretary of state's office determined they had collected more than the 694,354 valid signatures needed.

The new measure would insert the sentence, "Only marriage between a man and a woman is valid or recognized in California," into the state constitution, thereby overruling the court's decision.

Well, we knew that was coming. And at least the language wouldn't go and get rid of the state's DP's.

California has one of the best state apparatuses out there when it comes to LGBT activism. And the state has moved significantly towards accepting the idea that two dudes or two ladies can marry in their state. Take that with Democrats being overall much more enthused about this race than Republicans (months after becoming the presumptive nominee, McCain is still losing a quarter of the primary vote to people who just show up to show how much they hate him) and Obama registering and exciting a whole bunch of young and progressive voters, and we might see the second marriage ban rejected at the polls in the history of the country, with this being the first that focused exclusively on marriage (in Arizona, the strategy focused on the fact that their ballot initiative went beyond just banning marriage).

Also, there will be marriages in the interim, even with ten other states writing a letter to California to have their decision stayed until November:

10 state attorneys general wrote a letter to the California Supreme Court asking them to delay their decision until the November election. And [CA attorney general] Jerry Brown's all "no thanks!"

So there we go.

Just let the homophobes keep on making their religion-based hate and bigotry obvious. Eventually it will be clear they have nothing but their mean-spirited superstitions to base their actions on. In the meantime, these assholes should be forced to surrender something. In payment for their singling out of millions of taxpaying American citizens for discrimination, these cretinous louts should have to give up some right of equal value.

There is no correlation between freedom, liberty and the tool of governance we term democracy.

Freedom and liberty are about your right to live as you choose. Democracy is a tool to delegate responsibility for the passing of laws, national defense, etc.

Note to those who enjoy being "populists"--this is you in one form or another: using the power of the ballot to get your way at the expense of others.

I would guess this will go on over and over unless it is approved for about 3 years. then there will be grumbling and threats to bring it back, but everyone will have finally realized its not a big deal, the sun still rises every morning, the birds still sing and in the end this whole thing didn't really matter.

How about, if Gays and Lesbians , because of Constitutional discriminations, being unable to qualify for marriage benefits, insurance, hospitalisation, and a negitive social status, that of being "second class citizens", Gays and Lesbians should get a large break in taxes. Say 85% or more. If you don't support my human rights , hey, I don't have to financially support your discriminations of me, If I can't have it both ways, you can't either....The tax break should be enough to protect our families, our pets and the caution we have to take any time we are in public because of the violence againest us, "Bashings- Murder -Harrassment in schools and lack of respect from equlity in the Armed Forces and discrimination by Police Departments". Heterosexuals take all of these privilages, securities and trusts for granted! Mostly to practice forms of sexism and to ramain within
an insulated world made by "Them" and for "Them".

Not enough to defeat the measure: new definition of marriage needed

Californians should defeat the defeatist measure in November, no question. But better than knocking down an unjust referendum would be proposing a just one: amend the constitution with a definition allows for any two persons to marry, regardless of sex or gender. Otherwise, we'll just see the punishmentalists continuing to mount their campaigns of intolerance over and again.
