A week or so ago we noted Andrew Sullivan's prediction that Bush would one day face a war crimes tribunal. If anyone I know were in charge, he certainly would. But, as we stated then, political realities in the U.S. make it just plain wishful thinking. Still... last night ABC News ran with a story that certainly points precisely towards a trip to the Hague. Short version: the Regime's top operatives-- Cheney, Condoleeza Rice, Rumsfeld, Tenet, John Ashcroft, Colin Powell-- sat around the White House discussing and approving clearly illegal torture specifics.

In interview with ABC's Charles Gibson last year, Tenet said: "It was authorized. It was legal, according to the Attorney General of the United States."
But this is the first time sources have disclosed that a handful of the most senior advisers in the White House explicitly approved the details of the program. According to multiple sources, it was members of the Principals Committee that not only discussed specific plans and specific interrogation methods, but approved them.

...According to a top official, Ashcroft asked aloud after one meeting: "Why are we talking about this in the White House? History will not judge this kindly."
I doubt they care about speculation that "history" may judge them badly. Like the pope, history has no regiments. Some, on the other hand, think a Justice Department, cleared of the political hacks who have dragged it into overall complicity, will be duty-bound to look into the patterns of criminality and follow the leads wherever they go. Others, on the far right, point out that the Bush Regime have erected legalistic barriers to protect itself. I'm an optimist by nature... but only to a point. And I'm afraid History's judgment is the most satisfaction anyone will ever get out of this, the most disgraceful departure from constitutional rule and honor in the life of our nation.

Keep in mind that many Americans, probably even a majority, believe (wrongly) that IF Bush and Cheney and the rest had done ANYTHING illegal, then they would have been impeached by now!
(Because, you see, according to these Americans, the Democrats in Congress are SO partisan that they would have JUMPED at the chance to impeach if there was ANY merit to the "wacko" Left's views that serious crimes have been committed by those at the top.)

There are actually many people who really believe this!

Don't you REALLY think they missed some CRUCIAL ITEM in their coverup attempt? I mean REALLY, look at all the things that have already slithered out to the public. All the people who have their butts on the line will slither out from under their rocks and sing like canaries after Bush leaves office and can no longer pardon them, leaving the cell doors wide open for them unless they can make a deal. None of THEM, NOT EVEN BUSH controls what goes on in other governments, EVEN THE ONES WHO FOLLOWED BUSH LIKE PUPPIES, THE BRITS FOR EXAMPLE, WILL TURN LIKE THE SNAKES THEY ARE WHEN BUSH IS GONE.

And the US Attorney General presides over the International Court of Justice since when, again?

the proof (as if we needed any) that would be needed to prosecute for war crimes.

I listened to Jonathan Turley, constitutional scholar, tonight on Keith Olbermann, and he said that, yes, in fact, this is proof that crimes were committed. And the fact that they discussed and designed each individual detainee's specific torture methods (designer torture!) shows proof, and that it could be prosecuted. He said the big question will be if anyone at the Hague would be willing to prosecute them. But there is no question that they could - and should.

Pitchforks and torches, indeed!

I think I have read in the past that an American citizen, um war criminal, can only be handed over to the Hague for trial with the consent of the US Congress. If I have that correct, how likely is it that any successive congress going to grant permission?
