Mukasey Lets Bolten and Miers Off the Hook

We expected nothing less from the guy who can't figure out if waterboarding is torture or just a minor annoyance... unless it's done to him:

Attorney General Michael Mukasey refused Friday to refer the House's contempt citations against two of President Bush's top aides to a federal grand jury. Mukasey said White House Chief of Staff Josh Bolten and former presidential counsel Harriet Miers committed no crime.

So can I refuse subpoenas too? Not that I've ever been subpoenaed, or would be, should be, could be, shall be, or expect to be subpoenaed...

As promised, House Speaker Nancy Pelosi announced that she has given the Judiciary Committee authority to file a lawsuit against Bolten and Miers in federal court.

"The House shall do so promptly," she said in a statement. [...] "The American people demand that we uphold the law," Pelosi said. "As public officials, we take an oath to uphold the Constitution and protect our system of checks and balances and our civil lawsuit seeks to do just that."

I didn't realize we still had a system of checks and balances. On the other hand, I know we have a system of checks... and they all go out to Big Oil and Enormous Pharma. And last time I looked, I noticed that we do have a system of imbalances. And a White House full of the unbalanced.

Mukasey said Bolten and Miers were right in ignoring subpoenas to provide Congress with White House documents or testify about the firings of federal prosecutors.

And then there's the political angle, and what an angle it is!

The suit had a political purpose too. Democrats have urged that the filing occur swiftly so that a judge might rule before the November elections, when all 435 House seats and a third of the Senate are up for grabs. Criticism of Bush's use of executive power is a key tenet of the Democrats' platform, from the presidential race on down. [...]

Can you figure out who's on the right side of this one? And by "right", I mean logical, correct, ethically/morally/legally sound, not "right" as in Republican:

Democrats say Bush's instructions to Miers and Bolten to ignore the House Judiciary Committee's subpoenas was an abuse of power and an effort to block an effort to find out whether the White House directed the firing of nine U.S. attorneys in 2006 for political reasons.

Republicans call the whole affair a political game and walked out of the House vote on the contempt citations in protest.

Oh yeah? Well, I protest the Right's contempt for contempt citations. And I'm right... as in Democrat.

For the last five years, I have been imploring Congress to stop wasting time flailing at the endless stream of obstacles the Bush Administration keeps throwing into the path of Congress in the execution of its Constitutional duties, while it blithely goes on its way destroying or democracy. Go after the source - IMPEACH BUSH AND CHENEY NOW, before he completely destroys the US and possibly the world!

Bush and friends are the mob that controls the police, the prosecutors, everyone on up. No one in the administration will EVER be held accountable for their infinite crimes because those that would prosecute them are corrupt too. The law is its own opposite.
And the Democrats certainly won't lift a finger to do anything, if they even could. And even the media is on the take.
The entire system is corroded with cancerous rot. And this cancer is inoperable.

Hey, what the country needs now isn't simple "change". No, what the country needs now is a 100% 180-DEGREE COMPLETE AND UTTER FULL-FORCE REVERSAL of where it is heading now -- in so many ways.

How many of you have heard about HR676 now being proposed in the U.S. House?? None--why does that not suprize me.

On the back cover of NATION Magazine (3-10-08) is an ad being co-sponsered by the California Nurses Assn. and thre National Nurses Organizing committee to give ALL Americans the same health insurance plan enjoyed by our Congress and idiot in waiting, Dick Cheney for whom the bill is named.

In short, bypassing the money monster Insurance Industry and seriously damaging the Drug Industry. Why you will never see this ad.

This is the first time to my knowledge that someone has given to the "We the People" the means to have some influence in getting a bill that will actually benefit the all us lowlifes.

Where to start: Google CHENEYCARE.ORG, SIGN UP AND FOR ONCE ACTUALLY GET OFF YOUR DEAD ASSES AND DO SOMETHING TO HELP YOURSELVES!!

I realize I'm not a lawyer but it seems to me the Judges and juries are the only ones that can decide if someone is guilty of committing a crime.

The minute the Dem's gained control of Congress, with Nancy Pelosi heading the House, she declared that "impeachment is off the table". I'm now beginning to see why.

With the minority Republicans, at every turn, wailing that anything the Dem's attempted to do in reining in this Administration's illegalities was purely political, Pelosi would cave.

Did she have a long-term objective?
If she were to begin impeachment hearings, knowing full well that she didn't have the votes to go anywhere with it (though making points with the Dem base), the Republican's would cry foul, vomit out the "it's all politcal" screed and divide the Moderates and Independents - during an election year.

Did she feel that accepting appearing weak and impotent in the eyes of her constituency was the smarter move in order to avoid damaging the Dem's chances of victory in November?

We all told about what a tough and Independent Judge Mukasey was and that HE would truly be the PEOPLE's Lawyer . So much for that steaming pile of Dog Doo . I was under the impression that there is such thing as contempt of Congress .

This is not surprising, nor unexpected. Mukasey will earn high marks from his boss. His employer (US citizens), on the other hand, should dismiss this poor excuse for a judge. He is Alberto Gonzalez with 2 more IQ points (he lies with bigger words).

why there have not been IMPEACHMENT HEARINGS ON BOTH CHENEY AND BUSH. Does anyone think they are not constantly breaking the law?

Where are the agents of change of Obamanation?

Here is your chance to force change and you yellow, cheap folding chairs are MIA.

Impeachment may not have enough votes but at least it would get all these disparate attacks on the constitution and democracy in one forum so people could see the coordinated assault.

Would you support an aggressive fighter or an inept politician who was outmaneuvered on points they should have anticipated.

Perhaps, like in those other days when the War Department was magically transformed into the Department of Defense, we change the name of another Department: a more suitable name for the Department of Justice is Department of Rationalization; it has little or nothing to do with justice. Thus what is Crime in the Lower Orders can easily be rationalized to become Virtue in the Higher (which has most always been the case anyhow).

It's kinda fun to watch words and concepts float up through the ranks and the orders in this consequential age of ours and behold them transformed from the Bad to the Good, from the Negative to the Positive, especially with regard to terms of law and ethics. Then again, it's also kinda tragic. Its imaginative, creative, downright literary. If denotation works against you, just alter the connotation which in turn will slowly alter the denotation (dictionaries from different periods are happy hunting grounds for this!).

Meanwhile, many criminals will retire to exemplary,virtuous and meaningful lives to be "spent with their families and loved ones". This is part of Mukasey's functional job-description through the rest of this year.

Such is the Charm and the Magic of Power.

the Eliot Richardson or John Dean or William Ruckelshaus of this Justice Department? These guys resigned rather than do the political bidding of Nixon! They stood up. They said no. Is there one honest person left in this Department of Justice? Just one? Or have they all, long ago, been swept from the building?

There is no rule of law in America.

What is leadership? Leadership means getting out in front of where people are and waking them up. Right now, given these violent possible threats to us and our families, we are sleeping.

Which is why I am formally coming out of the closet with my support for Senator Barack Obama. Of all the candidates running now, he is the leader on understanding the threat to the Constitution and actually taking action, not just mouthing soundbites, on the need to deny torturers space in our nation and to restore the rule of law.

"Lawyers for Gitmo detainees endorse Obama," read a recent headline on the Boston Globe's political blog. In the article, reporter Charlie Savage notes that "More than 80 volunteer lawyers for Guantanamo Bay detainees today endorsed Illinois Senator Barack Obama's presidential bid. The attorneys said in a joint statement that they believed Obama was the best choice to roll back the Bush-Cheney administration's detention policies in the war on terrorism and thereby to 'restore the rule of law, demonstrate our commitment to human rights, and repair our reputation in the world community.'"

The lawyers who signed this letter -- prominent names on the list included Washington lawyer Thomas Wilner, retired federal appeals court judge John Gibbons, and retired Rear Admiral Donald Guter, who was the Navy's top JAG officer from 2000 to 2002 -- applauded Obama for having stood up in 2006 against aspects of the Military Commissions Act. Unfortunately, his fight was ultimately unsuccessful -- which is why we are all still in danger. But unlike other candidates he truly fought and he understood the nature of the danger: "When we were walking the halls of the Capitol trying to win over enough Senators to beat back the Administration's bill, Senator Obama made his key staffers and even his offices available to help us," the lawyers wrote. "Senator Obama worked with us to count the votes, and he personally lobbied colleagues who worried about the political ramifications of voting to preserve habeas corpus for the men held at Guantanamo. He has understood that our strength as a nation stems from our commitment to our core values, and that we are strong enough to protect both our security and those values. Senator Obama demonstrated real leadership then and since, continuing to raise Guantanamo and habeas corpus in his speeches and in the debates."

I say this with regret: She and her husband really know how to run a country; they delivered eight years of peace and prosperity. But that is not enough right now. These are times that should try men's souls -- and women's also. In a closing society, a leader has to be willing to face down evil, engage it and call it by its name.

Remember: when activists started to push hard to raise awareness of the dangers of torture and indefinite detention, many on the Hill were scared to join the fight because it was then politically unpopular. But to me, if you are not really against torture -- always and under every political change in climate, and let us note that former torture victim and prisoner of war John McCain shamefully dropped his fight against the torture loopholes in the law as well -- then you are not really, in my view, fit to be an American President.

Gender has nothing to do with it. Race has nothing to do with it.

Integrity has something to do with it.

That is why Barack Obama has my vote. Of all the leading candidates, he is the only one on these issues who has consistently acted like a true American.
