Is Mukasey Worse Than Gonzales?

Via The Nation, John Nichols explains why Michael Mukasey is much worse than Alberto Gonzales ever was:

For instance, he has defended the administration's attempts to dramatically expand the definition of executive privilege, telling the Judiciary Committee that it would be inappropriate for a U.S. attorney to press for contempt charges against a White House official who claimed to be protected by a grant of executive privilege. Under this reading of the law, U.S. attorneys would cease to be independent defenders of the rule of law and become mere extensions of the White House.

Guess he's not as "independent" as he says he is. I'm getting angrier by the second with Dianne Lieberman.

As such, Mukasey accepts a politicization of U.S. Attorneys far more extreme than that attempted by Gonzales and former White House political czar Karl Rove when they sought to remove U.S. Attorneys who failed to fully embrace the administration's electoral and ideological goals.

On to unwarranted wiretaps:

But Mukasey does not stop there.

Under questioning from Feingold, Mukasey endorsed the administration's argument that congressional attempts to define appropriate surveillance strategies and techniques could infringe inappropriately on presidential authority.

When pressed by Feingold, Mukasey refused to say whether he thought the president could order a violation of federal wiretapping rules. Feingold's response was measured. "I find your equivocation here somewhat troubling," said the senator.

And because he's smarter, more articulate, and more adept at answering, he's that much more dangerous:

In fact, everything about Mukasey's testimony suggested that he would as Attorney General be more of a threat to Constitutional governance than the inept and frequently inarticulate Gonzales. Mukasey gives every indication that he is as enthusiastic as was Gonzales about helping the president to bend and break they law. The scary thing is that Mukasey appears to be a good deal abler when it comes to cloaking lawlessness in a veneer of legal uncertainty.

Read: Better at legal doubletalk, better at fooling a willingly-fooled Congress, better at getting what Bush wants.

Consider the nominee's suggestion that the president can ignore any law, including the Foreign Intelligence Surveillance Act, if he and his lawyers determine that the law impinges on his authority as commander in chief during wartime.

"The president is not putting somebody above the law; the president is putting somebody within the law," Mukasey explained, with a response that employed legalese at levels not heard in Washington since Richard Nixon boarded that last plane for San Clemente. "The president doesn't stand above the law. But the law emphatically includes the Constitution."

And we're watching this happen. We're sitting in front of our CSPAN3s and witnessing this horrific train wreck as it occurs. That explains the sick feeling in our stomachs right now.

Leahy said after that "troubling" statement by the man who would be the nation's chief law enforcement officer: "I see a loophole big enough to drive a truck through."

The Judiciary Committee chair is right. It's the truck carrying the trappings of an imperial presidency. And Mukasey should not be handed the keys.

We need a designated driver. Now.

I am so totally confused! What are the rules to this stupid game? If the rules are similar to baseball, isn't this strike number 3,499? What is it going to take for America to finally get off their butt and say, "You're out jackass, quit swinging the bat!"

The GOP calls this growing abomination a "Democracy". If this is their idea of democracy, America would be better off with Idi Amin calling the shots. At least everyone in his country and the world knew he was insane! They all knew it was never wise to accept a dinner invitation from him because... You Were Dinner! We are the only country left in the world that refuses to accept the fact that our leaders are insane madmen, hell-bent on world domination at any cost, while we happily continue shopping at the mall!

Have Americans become so stupid that we are unable to recognize "crazy as hell" anymore?

This is what "No Child Left Behind", better known as "The Dumbing Down of America" has done to our country.
We have become a nation of morons who are incapable of recognizing the fact that Michael Myers, Freddie Kruger, and their merry band of psychopaths have kicked in our front door and are waiting for us to extract our heads from our anal cavities so they can terrorize us just a little more before they collectively dismember us on FOX Networks prime time reality TV. It's beyond comprehension!

Don't Step on the Grass Sam It is THE song for a pothead revolt, you gotta LOVE the mule.

I want everyone to know this band plays very loud, you gotta have ear plugs or they will hurt your ears. I notice it is posted real quiet though so you gotta buy the CD to hear it LOUD.

What person here really believed that Bush would put up for AG anyone other than someone who could be counted on to support his overthrow of the government? Such a thought is just plain ridiculous! Bush needs someone to justify his overthrow of this nation, and if you want a close look at our future, look at Pakistan today - that is our future in 2009!

I am so sick of the DINOs that are so willing to betray their party, the people who voted for them and the constitution of the US!

The lines have never been more clearly drawn. Enablers of the fascist dictator-to-be are fascists! They have no right to call themselves progressives - or conservatives, for that matter.

I am conservative. I believe in the constitution, conserving natural resources and the environment, the right of individuals to be free of unwarranted (in all it's meanings) government intrusion, responsible fiscal policy and personal liberty.

I am also progressive. I believe the Bill of Rights is the law of the land, the election process should reflect the will of the people, that "trickle up" economics is infinitely more conducive to general prosperity than enabling the robber barons. That it is smart to educate, decently house, and feed the poor. That in an industrialized society like ours health care is a human right.

Both lists could be longer.

We are witnessing a fascist takeover of our country. Some few in congress are fighting it. Virtually all of the traitorous Republicans are actively promoting it. They are joined by equally traitorous Democrats like Feinstein and Shumer who are willing to be enablers.

I will not forget, nor will I excuse.

Birds of a feather, etc. What bothers me is the way the questioning goes. Why is everyone so polite and afraid to confront this guy. I understand why some will vote against him. What troubles me is why anyone would vote FOR him. Why do they really believe that he's qualified? What great things has he done. The process gets so twisted that we lose sight of plain old 'yes or no'. Everything becomes a 3 ring circus and the meaning is lost. Thanks, ANNA

The Dems have balls the size of chickpeas and the Refucklicans are the least moral people in the country. The Congress might as well hang up a sign on the Capitol saying "Gone Out of Business."

I think we just need a sign that says we want to give Democracy to Iraq since we couldn't make it work here. My God, I am so angry with the lack of willingness on the part of some Democrats to act. Again, I encourage everyone to watch "The Power of Nightmares 1: The Rise of the Politics of Fear". It might give some ideas about what really is going on. I don't think that Schumer is stupid nor do I think Feinstein is (I admit I could be wrong on both counts) but I just can't believe that they are so out of touch. It has to be pressure and one hell of a lot of it. So, where is it coming from.

I hope everyone is supporting Kucinich and his Impeachment of Cheney that he's trying to get to the floor of the House. Listen, the democrats are not accomplishing one thing, so I figure they might as well as least let the country know that they think this administration belongs behind bars. Maybe they'll have a chance of getting re-elected. If not, hey, there are people who will happily do what needs to be done.

What is it that keeps this government from exposing the interests which keep driving us towards war??? Is it this government, or his heritage, as an Orthodox Jew, which will motivate the decisions/actions of Mulkasey should he become Attorney General of this great nation???
