Air Force Charges Victim in Her Own Rape

This news item made my stomach turn: Cassandra Hernandez, a female Air Force airman was raped, reported her attack and then subsequently became a court-martial defendant, herself.

The story goes down like this: Hernandez was at a party, where she was drinking. She says that three male airman raped her. She went to the hospital and filed a report accusing her attackers. Due to stress and harsh interrogation tactics by the Air Force, she eventually refused to testify against the airmen.

The Air Force then charged her with underage drinking (of which she admits to being guilty, but that's hardly the point, now is it?) and, along with her three attackers, "indecent acts." I had a hell of a lot of trouble finding an official definition for "indecent acts," and the best one I came up with is a "form of immorality relating to sexual impurity which is not only grossly vulgar, obscene, and repugnant to common propriety, but tends to excite lust and deprave the morals with respect to sexual relations." Someone correct me if I'm wrong, but the basic translation seems to be "a sexual act, particularly one that is not generally accepted in society, such as sex with multiple partners."

So. The woman was raped. By three men. She reported her rape. She was harassed by her superiors, to the point where she became too afraid to testify. The Air Force took this as meaning that the sex was therefore consensual (which isn't what it means at all), and charged her in the case of her own rape. If she loses her case, she could be publicly registered as a sex offender.

Sounds like it couldn't get any worse, right? But it does. How? The three alleged attackers were offered sexual assault immunity to testify against Hernandez on the indecent acts charge. Having at least half a brain cell among them, they accepted.

Sorry, but there's too much missing from this story. Women are raped everyday under some strange circumstances. If someone thinks it's amusing to 'make stuff up' it should be checked out. I need more to go on here. What else does the writer have to offer? Thanks, ANNA

I'm not sure what it is, but the Air Force, in particular among the service branches, has a culture of sexual assault.

Feministing is just starting to wake up to the fact that sexual assault -- complete with nothing but cover-ups at best, reprisals and worse for the victims -- is a fact of life in the male-dominated professions.

They're just getting past the stage of blaming the victim, and starting to realize that diligence in gathering evidence is key to building a case-- and being outraged at the fact that without solid evidence, women in these fields just have to put up with it, or leave the profession -- in disgrace., since they WILL conduct a whispering campaign, even if she didn't complain.

Sadly.

Heck, some of them still think gals should "be easier to get along with" in the circumstances (frat boy behavior, sexual harassment) that lead up to this -- not having the hard experience to realize of course, that not prosecuting the lesser offenses just sets the stage for the more serious offenses.

Oh well. Either they'll find out soon enough, or they'll retreat into a world of whitebread academic feminist theory and rhetoric completely divorced from the horrible reality that working women face -- and fight -- on a daily basis in the male-dominated work environments.

It looks to me, from their attention to this story, that they're learning. They're lucky to not have to learn the hard way.

I know at least 1 person involved in this case, and it is not a hoax. The airman in the rape was under aged, drinking, and was told there would be three trials, and I think she knew what was coming if she did testify. It didn't matter --- she got screwed anyway.

Unfortunately, no dates are given here.

Last I checked the Air Force had made moves to prevent this sort of thing from happening (i.e. women can report rape without being charged for underaged drinking in the Air Force regardless of circumstances).

Just found the story on "Air Force.com" their own paper, if anyone wants to check it out. Sadly, it's true. To me it reads better than the other stuff. Certainly is alot to think about. Thanks, ANNA

I looked up the original story which gives a bit more background on why Hernandez would drop her charges. (And remember people she is young, young enough to be charged with underage drinking. As I recall, I was immature at that age, old enough to be treated as an adult, but stupid enough to believe an army recruiter.

FATETTEVILLE, NC -- When Airman First Class Cassandra Hernandez enlisted in the Air Force two years ago, she says she was carrying on a family tradition.

"I just felt like I was able bodied, I just wanted to be part of something bigger than myself," said Hernandez

But during a party on base last summer, she says that hope for tradition and pride was nearly destroyed by three fellow airmen.

"Later on that night I was just gang raped by those three men, " she said.

The Air Force Security Forces launched an inquiry, and three airmen were formally charged with rape.

But then late last year, an attorney representing one of the accused, set up a series of interviews with Hernandez.

Her on-base victim's advocate was not allowed to sit in on the interviews.

“It was very uncomfortable, it felt like I was being interrogated,” Hernandez said.

Following that interview, Hernandez decided not to testify against her alleged attackers.

"We did an investigation and it did not support going to trial,” said Pope Air Force Base Spokesman Ed Drohan, “But it did support taking administrative actions against everyone involved."

The rape charges were dropped against the three Airmen who were accused and they were given small fines and a reduction in rank.

But they have now been granted letters of immunity so that they can testify against Hernandez.

Hernandez’ two Air Force attorneys say this is an unprecedented case.

"The idea of taking that and then turning it around and granting that individual immunity to testify against the victim, it's un-immaginable,” said Captain Omar Ashmawy “It was unimanginable to me until I took this case."

Pope Air Force Base spokesman Ed Drohan would not answer questions about the immunity that has been granted for the three Airmen for their testimony against Hernandez.

He said that is part of the ongoing Court Marshal against Hernandez.

Cassandra Hernandez is scheduled for trial September 24.

She’s charged with under aged drinking and committing an indecent act.

This is how a woman is treated under Sharia (Koranic) law. What is the point of fighting Al Qa'eda and the Taliban while importing their value system into the USA?

Nah, these are Xtian values at work. The Air Force is only doing what Jesus tells them to.

Feministing has a bad habit of howling when there's blood in the water rather than revealing all the facts. I had to dig really deep to get more info on what is going on in this case. Tip for the fine feministachix, report all the details then howl. Nobody likes to be a dupe and a good feminist has to know better because the chauvanists are only too willing to find holes to exploit, usually in spite of the facts but if the complaining party never brings up the facts... but hey, Cara's 22. Jessica doesn't make rookie mistakes like that.

And of course, always remember that Jesus runs the nation, via his messiah, lil george and his pals at the pentagon.

The military has been shaved to a shell of its once proud self by this gang of war criminals.

My daughter was in the Air Force and told many stories of the religiosity that has become almost institutionalized in the leadership...enough said. Religion + power = any type of depravity you can dream up.
