Marge Do you want your son to become Chief Justice of the Supreme Court, or a sleazy male stripper?
Homer: Can't he be both, like the late Earl Warren?
Marge: Earl Warren wasn't a stripper!
Homer: Now who's being naive?

If only Judge Scalia watched The Simpsons instead of that other Fox show, 24. He'd have an easier time distinguishing reality from fiction, and they might even write a joke about him.

As you've probably read by now, it seems our Justice Scalia, long revered by conservatives for his intellect, has been pointing to the exploits of TV's own Jack Bauer, to justify torture.

"Jack Bauer saved hundreds of thousands of lives," el Nino exclaimed to a group of judges discussing the issue of torture in Canada.

Actually, I doubt Scalia really is watching 24. If he were, he would know that the anti-terrorist agency CTU, where Jack Bauer works when he isn't being imprisoned, hunted, or tortured by Chinese/Arab/Russian thugs is:

A. Run by incompetent but well meaning nincompoops who can't even secure their own building from terrorist infiltration through sewer lines and probably the front door,

B. Staffed by computer geniuses who can't tell when their system is breached, and don't notice when the terrorists they desperately seek have set up shop just blocks away from them

C. Constantly letting terrorists escape when the bad guys use techniques like the old, they-got-in-their-SUVs-and-just-drove-away trick. In short, CTU is a pretty good approximation of FEMA, or the TSA. Or, of course, the Department of Homeland Security.

On the other hand, the staffers at CTU can be captured and tortured with a power drill to the shoulder one minute, and be back at their work stations the next, without so much as a whimper. Government employees, and no doubt unionized. Also, their cellphones work absolutely everywhere, even in the cargo hold of a jet at 20 thousand feet.

By the way, Judge Scalia, Jack Bauer (and by that I mean the fictional character) knows when he's breaking the law--it's just that he does it anyway. He's always willing to face the legal consequences because he knows torture is, in theory at least, illegal.

It's shocking to hear a Supreme Court justice utter statements like: "Jack Bauer saved Los Angeles!...Are you going to convict Jack Bauer?" but you have to admit it is consistent with his world view.

I wonder if he is planning to support Fred Thompson because he's been such a good district attorney.

On the other hand, it could be worse. We should be grateful that Scalia's apparently not a fan of The Simpsons' cartoon within a cartoon, "The Itchy and Scratchy Show". Gosh, what if a television-addled Scalia used Itchy as a role model for how cats should be treated?

"Are you going to convict Itchy? He wrapped a lit bomb up with Scratchy's tongue. Sure he blew Scratchy's head off just for fun, but Itchy saved Springfield!"

Antonin Scalia gave us George W. Bush as our president in 2001. Maybe, if we're very, very good, he'll help Jack Bauer become president in 2008. Although, personally, I'd like to see Chloe get a chance.

Digg!

So.. legal precedent... rule of law... constitutionality. No... lets just ignore all those things you learned in law school in favor of a television show.

Maybe Scalia also believes every case he hears that involves murder has been gone over with a finetooth comb by "CSI" people who have seemingly unlimited time and funding to pursue one case for days or even weeks... no matter how poor and unknown the poor and unknown the victim was.

Also... you can make anything but a boat out of coconuts and palm trees.

Also... if you lie about being gay to live with two women you can get lower rent.

All Scalia really needs to know he learned from watching government propaganda television. I'm sure this is some form of "meta" something or other.... propaganda feeding into the making of propaganda.

Someone get Scalia every season of the X Files on DVD so TV can teach him not to trust his own government!

I am embarrassed to have this jerk on the Supreme Court. I thought he might be someone I could be proud when he was appointed-but I am embarrassed and wish to apologize for this idiot. If Italians were all like him Christopher Columbus would have died in Genoa. lol

Meanwhile, back in reality, torture has been legalized

While the media hypes the stupidity of Scalia's statement as a way to promote a television show, the reality on the ground is that the United States has legalized torture under the euphemism of "enhanced interrogation techniques." The most important sentence in the Globe and Mail article isn't the Scalia quote, it's this one: "Then Lorne Waldman, the lawyer for the famously wronged engineer Maher Arar, emerged from the crowd to say that very little of the conversation sounded hypothetical to him." Also consider that this supreme charade garnered attention in the same week that Sy Hersh's article was published regarding the mistreatment Gen. Taguba experienced as a result of writing his report of the abuses at Abu Ghraib. Coincidence or distraction?

More duck hunting outings with Dick Cheney. As so aptly depicted by Mark Fiore's animation.
