Porno Pop-up Case Teacher Gets a New Trial

Posted by Adam Howard at 6:40 AM on June 7, 2007.

Julie Amero, a Connecticut substitute teacher unfairly prosecuted for accidentally showing porn to her students, is getting a second chance to defend herself.

AlterNet first began reporting on this story back in January and eventually the mainstream press also picked up the story and ran with it, but until now things looked pretty grim for Julie Amero. She was found guilty of intentionally showing her seventh grade students pornography even though she vehemently denied these charges and said that what the children saw was a pop-up ad which appeared under circumstances completely beyond her control. Amero, 40, would probably face about 40 years in jail if her conviction stood. But finally, yesterday, some good news.

According to Raw Story (via the AP), the computer in question was sent to a state lab to be analyzed and the results show a discrepancy between the computer's history and the evidence presented by the prosecutors presented during the initial trial. Amero and her defenders have said since the very beginning of this ordeal, back in 2004, that the computers the students were using was old and lacked the kind of spyware and firewall capabilities that would have prevented pornographic pop-up ads from appearing. "The jury may have relied, at least in part, on that faulty information,'' said Judge Hillary B. Strackbein, who granted the request for a new trial. This time, hopefully, Julie Amero will be exonerated by the facts instead of being overwhelmed by the hysteria over pornography

Every person with even a smidgeon of IT knowledge knew what a farce the original trial and conviction were. This time I expect they'll actually allow the defense to bring to light all the facts, instead of blocking it on technicalities.

It's to bad, even after this is all over I suspect that the teachers career is ruined. Hopefully she'll win some sort of compensation for having her good named ruined by an incompetent school IT department. Not to mention incompetent school officials, prosecutors, etc.

Certainly I have the best firewalls reasonable money can buy and I still get pornographic pop-up windows all the time. Shouldn't we be prosecuting those who make the pop-ups? In the UK anyway a large number of supermarkets and high street stores are selling porn directly to children and nothing is done about it.

This whole case is an absolute farce. It just shows you how anally retentive our courts have become with all these prissy Repug judges. Ditto the public in some places with their Holy Roller minions going around lecturing on the public morality. Pop-ups are a nuisance, especially the porno ones. Why didn't the school district provide spyware? Were they just too damned cheap?

it is good news that this teacher isn't going to jail, but will she be left with a great debt to her lawyers?
