Bob Geiger: Bush again sidesteps Senate wishes

In a move that should disgust all and surprise nobody, the White House announced today that George W. Bush will recess-appoint Sam Fox, who gave $50,000 to the Swift Boat Liars to help finance their 2004 smear of John Kerry, to be the new U.S. Ambassador to Belgium.

The nomination was withdrawn last week, when it became clear to Bush that Fox, who was instrumental in derailing Kerry's presidential bid, did not have enough votes in the Senate Foreign Relations Committee to be confirmed.

A recess appointment allows a president to fill vacancies while the Congress is on a break, even if the nominee has already been expressly or implicitly rejected by the Senate.

The announcement on the White House web site was buried in a flurry of other activity and said simply this:

The President intends to recess appoint the following individuals:
Sam Fox, of Missouri, to be Ambassador Extraordinary and Plenipotentiary of the United States of America to Belgium
"It's sad but not surprising that this White House would abuse the power of the presidency to reward a donor over the objections of the Senate," said Kerry, in a statement. "This nomination was withdrawn because the Administration realized it would lose in the Foreign Relations Committee. Unfortunately, when this White House can't win the game, they just change the rules, and America loses."

"Our country would be stronger if this Administration spent more time getting body armor for our soldiers in Iraq than it did helping their powerful friends."

Also reacting with outrage, is Chris Dodd (D-CT), who was the first Senator to publicly state his strong opposition to the Fox nomination.

"It is outrageous that the President has sought to stealthily appoint Sam Fox to the position of ambassador to Belgium when the President formally requested that the Fox nomination be withdrawn from the Senate because it was facing certain defeat in the Foreign Relations Committee last week," said Dodd. "I seriously question the legality of the President's use of the recess appointment authority in this instance. I intend to seek an opinion on the legality of this appointment from the General Accountability Office and invite other Senators to join with me in that request."

The move will allow Fox to serve as Ambassador to the important European ally until Bush leaves office and just became the most hideous recess appointment since the White House inflicted John Bolton on the United Nations with the same maneuver.

And Senator Dodd said it all about the appointment that will have many people wondering if the head Swift Boat Slimeball, John O'Neill, isn’t next in line to be rewarded for giving Bush four more years with which to trash our country.

Said Dodd: "This is underhanded and an abuse of Executive authority -- sadly this behavior has become the hallmark of this administration.”

ban recess appointments

It is obviously imperative for the next administration to ban this corrupt practise.

Do you believe in losing then? Do you think Bush should roll over and throw himself on the mercy of his enemies?

Or maybe you don't believe that all is fair in love and war (or the political versions thereof)? In other words, what right does anyone have to complain that Bush is using his power to get what he wants?

In order to do that, it is necessary to appeal to some kind of higher standard, higher than winning, that is. When was the last time you wrote about a standard other than winning? Come on. Be honest. Have you ever tried to make a case for a higher standard than winning? Admit it. You're really quite comfortable with power struggles, since you've been able to win more than your share of them. You wouldn't be getting published if you weren't a scrapper.

So who are you to throw stones? Without sin, are you now? Because only someone who takes sin seriously has any standing to blame a politician for using his political power. What Bush did wasn't illegal or immoral. Maybe it was indecent, but only prudes believe in decency. I haven't seen a prude published on these pages for a long time.

It appears that recess appointments are all that Bush has left. That and devious clauses inserted into the Patriot act to circumvent the Constitution...

Four years in to Iraq asking for patience, touting Christian values & these false republicans, radical wrong right are defending this appointment ! No the right, right & right left at center see this for what it is. How long has congress been out of town?

How long until he starts stamping his feet. There's very littLe he can do anyomore without meeting with resistance. The people in Belgium probably don't even know or care who this guy is. Bush will continue to be a a thorn in everyone's side until he's gone. Now, it's about damage control. More than anything he just looks foolish. Thanks, ANNA

...Harry Reid was going to have the Senate meet frequently enough so that there couldn't be a recess appointment. I don't remember where I heard that exactly, but I am pretty sure that was the plan.

The more W abuses the powers intrusted to him, the more damage he is doing to the Repugwican party. This will ensure an even bigger thumping at the polls in 2008. Bring it on W. Show us what the Repugwican Party is really about. Hopefully any Repugwicans will not be able to even elect a dog catcher for the next 20 years. Congress should take their majorities to cut off these abuses in the future. If a Constitutional Ammendment or Convention is required, lets get on with it.

This situation further reveals how 'our' ("Americans'" - whatever the hell that really means?) institutions are fundamentally out of synch with current reality. Above all because we, the people have been so virtually anesthetized for so bloody long!
