It's over. The New York Times:

Never mind that Senator George Allen of Virginia had not conceded. Jim Webb, his Democratic opponent, claimed victory Wednesday on the strength of a roughly 7,000-vote margin.

And The Associated Press, a widely accepted authority for calling elections, agreed with Mr. Webb, declaring Mr. Allen, a Republican, the loser.

UPDATE: Allen has a press conference at 3pm est....

UPDATE: 2:47 pm EST and Montana Democrat Tester has been declared the winner. Control of the Senate comes down to the outcome of the Allen/Webb race, in which Jim Webb has declared himself the winner.

In Virginia, Webb leads by about 7,000 votes, or a third of one percent, with 99.71 percent reporting. The count's been stuck there for about an hour -- since 2:30 EST. As of 3:30 EST, Tester leads in Montana by 2 points, with 75 percent reporting. Outstanding are Gallatin and Cascade counties, which should go for Tester. Looking very good for the Senate.

The Dems held vulnerable Senate seats in Minnesota, Maryland (open) and New Jersey. They picked up Ohio, Pennsylvania and Rhode Island early in the evening.

But all night long it looked as if they'd fall short. Republican Jon Kyl beat Pederson in Arizona -- considered a long-shot -- Claire McCaskill was trailing Jim Talent in Missouri and Jim Webb was losing to George "Macaca" Allen in Virginia.

It certainly looked like the GOP would hold the Senate. But Webb started coming back after 97 percent of precincts had reported in Virginia. And McCaskill made a move late in the game in Missouri.

Currently, the Senate looks like this:

Dems: 46 47

Republicans: 49

Bernie Sanders + Joe Lieberman independents

McCaskill won leads talent by 1 percent (15,000 votes) with 81 percent of precincts reporting and Webb leads Allen by one 10th of 1 percent (2,700 votes) with 99 percent of precincts reporting. The only remaining precincts are in counties in which Webb is doing well. According to Virginia law, a losing candidate can request a recount if the margin is less than one percent. Webb has declared victory (as a candidate should when a race is likely to be contested).

Montana was the only action in the West, and 52 percent of precincts are reporting. John Tester leads Conrad Burns 53-45 percent.

If everything holds up, the Senate will go to the Dems 51-49, assuming Lieberman caucuses with the Dems as he's said he would.

Still a ways to go.

Or if they were, there were so many voting dem, they couldn't pull it off anyway. LOL I am giddy..... I am hopeful for the first time in a long time. Its been one hellacious ride for 5 years. I just wish McKinney could have been there to enjoy the relief she would have felt having been so alone during her courageous opposition to this horrible administration and congress.

I'm feeling good. Claire McCaskill has won. We've finally got rid of Jim Talent. In Missouri one down, one more to go. We now need to get rid of Kit (I kiss Bush ass) Bond.

The race in Virginia is going to be litigated to death. It may be months until we find out for certain. I hope that Webb doesn't give in like Gore and Kerry did. And I also hope that the full treasury and lawyers of the Democratic party are behind him.

I am afraid this is Rove's November surprise. If we don't win in Virginia, it's irrefutable proof that the fix is in, IMO.

... Where the Dems are as crooked as a hog's penis: How do we vote against the neocons? Yesterday we voted GREEN.

Normally 70% Rep; 30% Dem, yesterday downstaters voted 55% Rep, 30% Dem, and 15% Green. Pissed at the Repubs, but not wanting to show approval for the Dems either, an amazing number of Illinoisans votedfor anything else they could get their hands on -- write-ins, Greens, whatever.

Republicans should certainly take this a a genuine defeat, but Democrats should not take this as a mandate for them. It was not.

This is no time to fall asleep at the switch because weasels like Biden, Kerry, Clinton, Feinstein, Bayh, Cantwell, Shumer and their likes (not to forget that uberweasel Lieberman) are lurking in the shadows ready to pounce.
People didn't vote for Dems so much as they badly wanted change in direction and ethics, so cosmetic posturing will not do.
Keep their feet to the fire, forcefully repeal the notion of presidential plenary powers, the entire Patriot cluster of acts, ban torture outright and bring to justice those who would practice it, same for unauthorized domestic spying, start full, no-holds-barred investigations into the energy task force, selling and management of Iraq war, the circumstances and handling of 9/11 and Katrina fiasco.
Forgive nothing!
Where is the charity and empathy that they ever showed to anyone outside their billionaire circle (The Base)?
To shove stuff under the rug on the premise of "let's move forward" is to stay the course, if nothing is wrong with Guantanamo and Abu Ghraib and no one is guilty of anything, then let's build more Abu Ghraibs, more torture farms in Tajikistan.
At this moment, there are neocons whispering this very notion into the ears of the new lawmakers.

From the NYT a few minutes ago:

"Ed Gillespie, the former chairman of the Republican National Committee, is in Richmond to monitor the vote-certification process and advise the Allen campaign. “The conclusion of the canvass will be the official result,” he said at a news briefing today. He said he believed a count of provisional ballots and a review of the state’s voting machines would turn up additional votes for Mr. Allen."

"In 2000, Gillespie served as senior communications advisor for the presidential campaign of George W. Bush, organizing the party convention program in Philadelphia for Bush's nomination and Bush's inauguration ceremony. He also played an aggressive role as spokesman for the Bush campaign during the vote recount in Florida."

only he's dumber than most. That guy's my former boss and he hated state worker with a passion, ensuring that we didn't get any raises and instituted a system where no merit raises can ever happen except for one person per college. Of course, he called this system "merit" system. You can, however, loose pay if you get a bad rating. Where did this money go, mostly to contractors who work across the state. We're building lots of things now, only paying people chicken feed to work in the buildings. So, take money from the government and education once again, and give it to the private sector. Typical neocon graft and corruption.

I hope he gets sued and looses his shirt. I have nothing but ill will towards him. Doubtless, his white supremacist buddies will put him up in some sugar shack so he can shoot squirrels and tie nooses in the mean time.

Okay. That's a little overboard, even by my standards. I'm not being Christian. All I really want is for him to go away and have a true change of heart and see all the horrible damage he's caused in people's lives. That won't likely happen but it would be nice.

See, we focused on economic justice, and we won! And social issues are going to be a lot better even with conservative Dems. Who do you think is more likely to abolish abortion in Pennsylvania...Bob Casey Jr or RICK SANTORUM? (I'm sure all the gay readers are sniggering at this point ;) )

Don't you think it's strange that the GOP isn't hissy fitting it's way into a recout frenzy? Here's my (conspirasy) theory: They can't demand a recout because if they do the rigging would show up and the margin of the Dem win would GREATLY increase. That said... glad that it couldn't be rigged enough and hope we fight on for real election reform, naitonal standards, a voting holiday, or more. How about a requirment to vote. Like making it illegal not to vote. If you don't vote you pay a fine... like $20 bucks or something. That way if we chose not to vote we pay for that choice...not the other way around.

mwildfire had a scary post in the Bob Geiger story in which he thinks Lieberman will wait till January and switch to the Republican Party, makes sense, Holy Joe has to repay the Rs SOMEWAY for all that campaign cash they gave him and let their own candidate go down.

I am happy with the outcome,but remember who is lurking in the wings. Cheney and Rove. No deceit too gross ,no swindle too low for these guys. And as long as they get to foment thier ideologies we are not safe.They and their friends will never have enough.Like cockroachs they will hide away and lay low until we least expect them.

There's no doubt about it, to see frothing Neo-Cons who have been strutting around like John Wayne for the past five years finally eat humble pie is a breath of fresh air, but let's not be so deluded as to think that the Neo-Con agenda, which took decades to craft, was simply brushed aside by the victory of a party that has supported Bush every step of the way on major issues.

Nancy Pelosi voted for the war in Afghanistan, for the Patriot Act, for Homeland Security and against a bill that simply condemned torture of prisoners in Iraq. Pelosi is the pro-torture "savior" who we are told will keep in check the pro-torture Bush administration.

As blogger Kurt Nimmo points out, "Making Bush and Cheney—that is to say, the neocons—lame ducks will add a jolt of adrenalin to the neocon plan to decimate the Muslim and Arab Middle East, lest the neolib faction, under a Democrat president and Congress, go back to its old ways, that is, instead of mass murdering Iranians in one fell swoop, imposing the sort of sanctions levied against Iraq under Clinton, resulting in the slow death of 1.5 million Iraqis, 500,000 of them children."

Will the now advanced plan to decimate US sovereignty and impose tracking and taxation controls on vehicle travel across the country under the NAFTA Superhighway be reversed under a Democrat House and Senate?

Will the Military Commissions Act, the very bill that effectively nullifies nine of the ten amendments to the U.S. Constitution be repealed under a Democrat House and Senate? Time will tell but it seems highly unlikely.

Will the army of surveillance cameras that have invaded American streets via Homeland Security grants be curtailed under a Democrat House and Senate? If anything big government and Big Brother will only get bigger.

Will increased pressure be heaped upon Bush to bring American troops home from Iraq, save the isolated echoes of dissent from lone dissidents like Murtha? No, and if Hillary Clinton rides the wave of Bush discontent all the way into the Oval Office, she has already promised to expand the so-called war on terror.

Will an independent investigation into the Bush administration's complicity in 9/11 be ordered under a Democratic House and Senate? No - and the same goes for lying about pre-war Iraq intelligence - Pelosi has already brazenly proclaimed that Neo-Con war criminals will have safe passage.

Pelosi is an obedient adherent to the phony doctrines of the "war on terror" and her recent comments that “The war in Iraq is making it harder for America to fight and win the war on terror,” only go to show that she disagrees on the minutia of where the troops should be on the map, not whether they should be there at all.

The worst case scenario, that the mid-terms would provide an endorsement of illegal eavesdropping, torture, imperial hegemony and the revoking of the bill of rights, has thankfully not been realized. The American people have rejected the Neo-Con agenda and dealt it a symbolic blow.
