Horrific: 12-Year Old Girl Beaten By Police for 'Resisting Arrest'

The girl was innocent and did not even fit the description of the alleged criminal the police were looking for.

This is horrific.

It was a little before 8 at night when the breaker went out at Emily Milburn's home in Galveston. She was busy preparing her children for school the next day, so she asked her 12-year-old daughter, Dymond, to pop outside and turn the switch back on.

As Dymond headed toward the breaker, a blue van drove up and three men jumped out rushing toward her. One of them grabbed her saying, "You're a prostitute. You're coming with me."

Dymond grabbed onto a tree and started screaming, "Daddy, Daddy, Daddy." One of the men covered her mouth. Two of the men beat her about the face and throat.

As it turned out, the three men were plain-clothed Galveston police officers who had been called to the area regarding three white prostitutes soliciting a white man and a black drug dealer.

All this is according to a lawsuit filed in Galveston federal court by Milburn against the officers. The lawsuit alleges that the officers thought Dymond, an African-American, was a hooker due to the "tight shorts" she was wearing, despite not fitting the racial description of any of the female suspects. The police went to the wrong house, two blocks away from the area of the reported illegal activity, Milburn's attorney, Anthony Griffin, tells Hair Balls.

After the incident, Dymond was hospitalized and suffered black eyes as well as throat and ear drum injuries.

Three weeks later, according to the lawsuit, police went to Dymond's school, where she was an honor student, and arrested her for assaulting a public servant. Griffin says the allegations stem from when Dymond fought back against the three men who were trying to take her from her home. The case went to trial, but the judge declared it a mistrial on the first day, says Griffin. The new trial is set for February.

"I think we'll be okay," says Griffin. "I don't think a jury will find a 12-year-old girl guilty who's just sitting outside her house. Any 12-year-old attacked by three men and told that she's a prostitute is going to scream and yell for Daddy and hit back and do whatever she can. She's scared to death."

Since the incident more than two years ago, Dymond regularly suffers nightmares in which police officers are raping and beating her and cutting off her fingers, according to the lawsuit.
Griffin says he expects to enter mediation with the officers in early 2009 to resolve the lawsuit.

So plain-clothed police officers beat up a little girl who they were wrongly arresting, and now the girl and her father are the ones in trouble for trying to defend her?

Dymond and her father did exactly what most people would do in that situation -- if anything, Dymond was exceptionally brave in fighting back and yelling for help. The fact that she's being criminalized for it is beyond comprehension.

Apparently the Milburns have filed a lawsuit against the police department. Hopefully they're successful.

This case is especially compelling because it involves an innocent 12-year-old girl who did not fit the description of the alleged criminal the police were looking for, and instead was targeted because she happened to have the bad luck of opening her own front door while wearing shorts and being black. But if the allegations against the police are true, it's troubling on an even deeper level -- because it's an illustration of what sex workers face every day, but are rarely able to fight back against.

Police offiers and other people in positions of power can victimize and abuse sex workers with almost no fear of retribution or legal consequence. The police beat up a 12-year-old girl because they thought she was a prostitute, and, if the news report is accurate, have said as much. Had she actually been a prostitute, that treatment would have apparently been acceptable.

The whole story is disgusting. I haven't read anything about the officers being suspended or fired, but I sure hope they're out on their asses for this.

the sadism, the power and control issues, the brutality, the idiocy OMG I didn't realize these people were so sick. They like to say "oh, there are a few bad apples" NO FOLKS- the good ones cover for the bad ones because of the steel blue code and the "good old boy" club.
Criminals with badges. Why my Captain was a felon, my LT was on the liquor control board before he was LT and he said he got stopped DRUNK DRIVING once and let go because of his position. No one lies more skillfully except lawyers and politicians. That is why a psychopath serial killer like Drew Peterson is walking around for the cameras

This municipality is looking at a huge judgment against them. There is zero way to justify the cops' conduct. And, the girl was totally justified to fight back tooth and claw against three men trying to abduct her from her yard.

If the victimized family doesn't win a BIG settlement, then what does that say to our kids, who may someday be forced into a rapist's vehicle?
If there isn't a big settlement, then this would say that you better not fight back, on the off chance those beating you or molesting you or trying to kill you are cops in disguise.

By the way, if the real prostitutes being sought and the little girl were of the same race, the cops actions still wouldn't have been right. But it shows even more negligence (a too kind word) by the police officers, the fact that the races differed.

The citizens in Canada and the U.S. seem to have forgotten that the police work for us. Our taxes pay their salaries. We should not allow them to abuse their powers. Speak up people.

I can't imagine what I'd do if this were my little girl. Some things are worth going to jail for. I'm anti-war and anti-violence but there's a line to be drawn. What kind of fathers are these men? Can't they realize that this could be one of their kids. What do these people learn in "training"? There are no conseqences for their actions. Most of the time they just walk. Even she was a prostitute, they no right to beat the crap out of her. ANNA

...just go read the message board for the top Alternet story about the black men shot by white vigilantes after Katrina.

According to the enlightened whites in the message board, the investigative report is "biased" because it doesn't acknowledge that blacks were assumed to be violent, assumed to be criminals, assumed to be looters, and therefore whites were innocent for shooting them. Similiar to this post, even if some blacks were "looting" (finding food, supplies and shelter doesn't count as such) it is NOT acceptable for white citizens to shoot them and it doesn't explain the failure of (white) authorities to investigate it.

But, to read the Alternet message board, whites are the victims, blacks are the criminals. Hey, even that 12 year "was asking for it."

This has been a wretched wretched day.

Here in Denver years ago the cops busted down the door (in a so-called "no-knock raid") of the wrong house, and shot and KILLED the innocent (Hispanic) man inside who dared try to try to defend himself from these intruders.

The prosecutor refused to charge the cops. As a matter of fact, in multiple cases of cops shooting people to death, the prosecutor refused to even investigate to see if the shooting were justified.

Meanwhile, that very same prosecutor charged a woman with the first-degree murder of a cop, even though the cop was actually killed by the woman's boyfriend while the woman was in police custody! The woman got life in prison. (But has since been released.)

That prosecutor's name? Bill Ritter, the current (Democratic) governor of Colorado.

Hi y'all, Chief Riley here wantin to set the record straight. Now my boys gettin a little riled what with all this hoo ha and the litle girl. They tole me they simply stopped to ask her where they were and the young person slipped, fell ovah an' in hurting herself called out for daddy. My boys wen' over to help her git up again. Hell, we have loads of darker skinned genelmun in our protection always falling over and bumping their heads on all kina things in the Galbeston Police (as we like to call it) Community Help & Advice Centre. This is all jus a little ole misunderstandin'.

This makes me sick. Those police officers ought to be charged with assault on a child. The department and city ought to be down on their knees apologizing to that family, not charging the victim with the 'crime' of defending herself against a brutal, unwarranted attack.

Wearing shorts while black is apparently a crime in Galveston. Anybody who thinks that the election of Obama has 'cured' racism in this country needs to have their heads examined.

If a child is out working the streets, a PUBLIC SAFETY OFFICER should be finding her parents who either put her out there or at the very least are Neglecting this childs needs.
A Badge Does NOT exonerate you from Child abuse, Nor does the illegal activitiy they may be involved in. It was a 12 yr Old CHILD!
Three officers can't restrain a 12 yr Girl? It requires them to beat the hell out of her? BULLSHIT, All three should b earrested for Child Abuse and since they did nothing to determine why or who put her out there (if she was a prostitute) constitutes Reckless endangerment(Was she being beaten and raped at Home and thus used to earn drug money?)
In fact why does the 'crime' of prostitution warrant such use of force regardless of the age of the offender? it's not a violent crime. How many adult prostitutes do these 'officers' Arrest in the same manner?If the are willing to exude such force on a 12 yr suspected prostitute, how much more force do they use when arresting an adult Caught in the act?
Sounds like a Standard Operating procedure for the Galveston Police, The entire Chain of command should be prosecuted, this obviously is the way they do business regardless of the age the suspect or situation.

for bringing this nasty story to our attention. As you point out, it sucks on every level - from the idea of three adults beating one child to recognizing all it implies about the treatment of sex workers. As we head deeper into economic disaster, more women will find sex work their only option, making your coverage all the more relevant.

Bush has made it okay to abuse the innocent, and get away with it.

Too bad 12 year olds cannot legally carry guns to defend themselves....I think they did back in the Founding Father's days.

And I am anti-gun/anti-hunting...but when it comes to something like this, also what happened during Katrina, what happens at most RNC demonstrations to those just passing by, to those killed by the TSA....and all these right-wing neocons can whine about is all the unborn the "left" kills....well once they are born, the "right" doesn't give a hoot about them....I may change my opinion on guns for all when it comes to self-defense, to defend yourself from the government!!!

OK, Jill, was the 12 year old girl grabbed while going out to turn the breaker back on, or was she grabbed while sitting on the porch? The story may be true, but your "facts" create suspicion.

Police are attacking the youth everywhere

This makes me wonder what might have happened had she been dragged off in the car if her parents had not been at home. The "officers" involved obviously had nothing but contempt for the young girl erroneously involved and would have meted out the same "primeval" justice to the actual suspects had they been caught.

Here in Australia, a teenage boy(15) with a knife was shot and killed and there was shooting of the teenage boy(15) in Greece recently by police. What seems to be developing is a pattern of abuse by the police of young people, perhaps to establish their "authorita" upon this particular age grouping. Thankfully some of the people of Greece actually rioted over the "police abuse of power", it should have occurred in Galveston and Melbourne as well, make that Australia and the USA

The failure of mainstream media to respond to these situations is probably more disturbing, giving police a free rein whatever their actions. Let's hope the courts will put these "officers" away, and set an example of accountability to all serving officers that they are working for the law and not employed to make up their own rules of police behaviour.

.....once again, this proves it. This hyper-masculinity is sociopthic. We live in what could justifiably be called a pathocracy; that is, sane people lorded over by criminally insane people----the military/academic/industrial complex, where people in general are reduced to simplistic abstractions for the sake of the almighty fucking dollar and barbaric power. And, once again, in spite of having elected a liberal, intelligent, and tolerant BLACK president, I am ashamed to have to call myself an American, because of these sick fucks with guns and NO FUCKING BRAINS!!!!

Better bring a bunch of weapons because it will always be okay for the police to defend themselves against you. Sad, but true. They need to be fought in the court system and make them pay with their jobs, prison time, and empty their bank accounts for their misdeeds. They need to lose their jobs and never be hired as a cop or guard ever again. They should be denied the right to own a weapon as well.

What we used to refer to as the "American Justice System," is now simply, the "American Injustice System." It is so systemically corrupt from top to bottom, that I don't think it will ever be corrected unless the majority in this country will start pulling their head's out their ass's and start facing reality.

The Galveston police chief is ultimately responsible for the police attack on the 12 year old girl. His job should be on the line. It's his duty to discipline and maintain his force under control at all times. This kind of egregious action on the part of the ploice should not happen. Beating up a young child is disgusting and perverse and these officers should be fired immediately. As far as charging her for resisting, that is absolutely outrageous and shows how depraved and unjust the police and prosecuting attorneys have become.

And the settlement should come directly out of the police budget. And if there have to be cuts in police personel, these cops and anyone else with similar complaints against them should be the first to go, regardless of seniority or anything else.

Dear Sir:

As far as I can tell, your police force cannot read street addresses, can't tell black from white, and regularly beats up prostitutes, so they thought it was okay to beat up a little girl who wasn't a prostitute, was at her own home which wasn't the address they were looking for, didn't match the description of the people they were looking for, and your department is now persecuting the girl and her father because she fought back against unidentified attackers who beat her for no reason whatsoever?

You're not a police force, you're a terrorist organization and you all belong in Guantanamo. You have no respect for this country, its citizens, or our Constitution.

If your daughter or, if you don't have a daughter, the daughter of some millionaire you respect, was beaten by unidentified assailants at her own home, for no reason whatsoever, would you prosecute her for trying to defend herself?

You are a disgrace to America and your department has no decency.

A week or so ago I wrote about the mental stability of cops and the fact that they can shoot any one of us at any time and get away with it and that got a lot response. Most of it stating that I was wrong, want to try again? Cops break into the wrong house on a warrant a kill a man in Denver (more than once) and what happens to the pigs? Nothing, but Denver loses lawsuit after lawsuit. So if the pigs are not out shooting citizens they are beating up little girls and giving them nightmares. Shame on all cops for letting this happen.

what if the person being attacked by the law had a little bit of Martial Arts training. I know I cannot but people in my class were black belt and they could perform death moves with ease. And one was a girl, 17. I fought against her on a sparing mat and yeah, she kicked my ass. What if the attacked person actually killed one of the plain clothes cops, in self defense. What would be said then?

This article did a fine job of arousing sympathy for an innocent child (a "good girl") who was attacked as being a criminal. However, the article was spoiled by the writer's sudden decision to go off on a completely different topic and start trying to arouse sympathy about "sex workers" (euphemism for prostitutes). Prostitution is a criminal activity in Texas. A prostitute, by definition a criminal under Texas law, cannot be compared in any way whatsoever to an innocent minor. If you want to elicit sympathy for prostitutes, find an "innocent" criminal who was beaten by police and play the violin music for her (him?). Don't tack it on to another story.

a 12-year-old child would be a victim of crime, not a perpetrator. I guess they hire cops based on aggression, not brains. This is so revolting.
