Ban on HIV+ Visitors and Immigrants in the U.S. is One Step Closer to Being Repealed

Hello, Progress -- nice to see you again:

The U.S. Senate has approved repeal of a law barring HIV-positive visitors and immigrants from entering the country. The measure was included in legislation reauthorizing PEPFAR, the President’s Emergency Plan for AIDS Relief.

The ban repeal measure was tacked onto the bill by Sens. John Kerry (D-MA) and Gordon Smith (R-OR) despite an effort by Sen. Jeff Sessions (R-AL) to block it.

PEPFAR passed the Senate with the Kerry-Smith provision by a vote of 80 to 16 and now moves to conference committee before being sent to the President.

…Gay and HIV/AIDS rights advocates have been fighting for repeal of the ban for more than a decade. The battle now focuses on keeping the language intact while PEPFAR moves through conference.

"We call on the leaders of the House and Senate to retain the Kerry-Smith provision in conference and ensure it is included in the final legislation sent to the President’s desk," said Human Rights Campaign President Joe Solmonese.

Aside from its intrinsic and immediate value if the repeal is signed into law, it's also a good first step toward undoing the immigration policy that prevents HIV+ foreign nationals from obtaining legal permanent residency in the US -- which itself is necessarily tied to any reform of the fiancée/marriage visa laws to include same-sex couples.

I cannot believe the venomous responses from the comments section. I believe the US should open it's doors, as it did in the beginning, to all regardless of their affliction. The arrogance of the responses I have seen reflects the haughtiness and conditional love of mankind that this capitalist country of ours has become and is seen, as such, by the people of the world

...and about time!

For a nation that prides itself on freedoms:
you seem to take away those that should be protected in one hand
while imbibing other laws that need reviewing and updating in the other!

Rights to individuality; laws should protect the right of a person to do what he wants to his own body regardless of implications... a womans right to choose will affect a mans rights to do to his body what he decides as well.

Free speech & Freedom of the press; we must protect free speech but at the same time controls must be enacted to protect our young and old from the influences of HATRED that hate speech generates, almost all freedom loving nations have this guarantee with the exception of the US!
...just outlaw hate...
WRT press, well we can thank Clinton42 and Republican controls for that mess!

A right to bear arms; which I agree with, seriously needs a modern updated review to reflect current ideals, which could be easily recognized and addressed simply by having all owners have mandatory insurance for possession [much like auto insurance] with a built in registry and ballistics mechanism.
all should have the right to unimpeded access to firearms but the innocent people caught in the crossfire deserve better protections.

I could go on but damn...
The US Federals seem to like doing everything ass backwards!

Finally:
This ban on not allowing people entry due to their HIV status in effects denies some people effective treatment options and stifles a persons ability to disclose a condition which they should disclose.

This Ban was reactionary, immoral and illegal and is another relic from Jesse Helms and his Re-thug-nican controlled house, senate and executive branch of the federals...
whats really sad though... was that the judiciary did nothing about it!
