Kucinich Wins Lawsuit Against NBC to Be Included in Debate

Now if the judge could rule that the cable shows had to talk about issues, not high school catfighting, we might have a real election here.

Damn good for Dennis-

A Las Vegas judge has ruled that democratic presidential candidate Dennis Kucinich must be included in the Tuesday night presidential debate in Las Vegas.

Kucinich filed a lawsuit against NBC. He said he was initially invited to be in the nationally televised debate but the offer was later rescinded. Base on the earlier invitation, Judge Charles Thompson ruled in Kucinich's favor saying if he isn't included, he will issue an injunction stopping the debate.

The judge will meet with lawyers from both sides to sign the court order at 4 p.m. The attorneys for NBC claim the state has no jurisdiction in this matter, but they declined to say what their next legal move, if any, will be.

Now if the judge could rule that the cable shows had to talk about issues, not high school catfighting, we might have a real election here.

Why Does NBC Care?

Nothing illustrates better the way the corporate media control and manipulate our elelctions. NBC is so determined to silence the only really progressive voice in this election that they are willing to go to court to keep Kucinich from participating--and even in the face of an injunction they are contemplating their next legal move! Why on earth should NBC care enough to spend the time and money to fight this issue? They know that Kucinich has a limited following, and that they can effectively silence him during the debate anyway just by ignoring him and asking questions that are completely Hillary and Obama-focused (e.g., "Why don't people find Hillary as likable as Obama?"). It is obviously worth an awful lot to them to ensure that the coronation by divine right of the corporate candidates is not interrupted by the voice of a commoner.

I am glad I checked before I went to bed. Good night everyone, I will sleep better knowing there is some hope for us after all. Go Dennis! We want to see justice served.

Today was a bad day for MSNBC, they are not much better or even different from FAUX. What a disappointment for so many of us. At least now I can look forward to the debate even happening.

Sweet. Of course, as another poster noted, there's still no guarantee that they'll even ask Kucinich a question. One certainly wonders how much (if any) mention NBC or the "valid" candidates will make of the not-so-secret scandal. Or, for that matter, how the man of the hour will (or will not) approach broaching the subject.

I think a lot of very important moves could be made, in terms of catching telling glimpses of each participant's true character.

As they say, "Stay Tuned"...

PS: I personally have seldom seen the level of enthusiastic, direct, precise activism on the part of Alterneters as I've witnessed over the last couple of days in regards to this issue. This includes coordinating phone & email protests, not just from DK die-hards, but from people backing other candidates (or none) who simply couldn't let this sort of thing slide yet again. Thanks are due to (the often frustrating) Alternet & it's writers/editors for providing the platform & information, as well as the gloriously fractured community, for this rare moment. While all that directed democratic vigor surely had little or nothing to do with the judge's decision, perhaps it will help convince NBC/MSNBC to hold off their dogs...

I imagine the judge gathered Kucinich was covered under the equal time clause, which states something to the effect that broadcast media entities cannot give one candidate more coverage or access than another.

By sending the original invitation and stating Dennis had met the requirements, the judge ruled they had a contract. They cannot, then, go and change the contract rules without the consent of the other party, Dennis. Now they are claiming the court has no jurisdiction? Well the court does have the right to enforce a contract or reward damages to the party, Dennis, who's contract was breached.
Unfortunately, the moderator will probably just ignore Dennis through the entire "debate" and focus on the "chosen 3".

What could they possibly argue? That they only want three candidates because three is better than four? That they can change the rules after learning who would be there?

What would they do if Biden or Richardson was in the fourth position in the polls? Is that who they were hoping to get?

Any answer they come up with can be easily shot down.

Why would anyone not want this man working for them in the White House? He's not going to take it lying down. The press and politicians need to learn that our system is first and foremost "FOR" the people. Go, Dennis!

I'll believe this court ruling and restore my faith in the judicial process when I actually see Kucinich up there tonight. But let's not count our chickens just yet.

Second obstacle - the mediator actually has to include Kucinich in the debate, and at least acknowledge his presence.

For a bonus, he would be given equal air time as the other candidates, but I wouldn't hold my breath.

Kuchinich has to walk a fine line. If he is up there tonight and given the chance to speak, he needs to temper his anger with NBC/GE, big media, etc. with the need to address America and let everyone know exactly what kind of a man he is. On the other hand, I feel the public should be informed of this debacle, so if it is not brought up by either the mediator or commentators prior to the debate, does he open the door himself? He can't come across as angry, or millions of people will tune him out immediately. God forbid if someone up there speaks with much passion and yes, a little bit of anger, especially given the times we live in.

I think it was Cesar Chavez who once said (in the struggle of farm workers versus corporate agribusiness), "It is our time versus their money -and we have much more time than they have money." This is equally true of our champion Dennis versus corporate media; for each additional common person like you and me who joins in protest and speaks out we effectively multiply the manhours of our time being actively pitted against the big corporate money paying lawyers and politicians to suppress any dissident voice (like Dennis) from being heard.

Corporations do not own the public airwaves and cannot be allowed to exclude voices like Dennis Kucinich's from being heard.

These people hate all minorities. That includes color and creed. They hate Dennis and when they hate Dennis they hate me. I do take it personally. I had planned a Nevada vacation. I think it is off. I don't watch MSNBC enough to hurt their ratings. They didn't let Ralph Nader on the ballot here last time. Now the DNC wants me to go to the polls and vote democrat. If they won't listen to Dennis, they won't listen to me. Why should I vote for them?

FCC broadcast rules do not apply to cable TV networks. MSNBC is a cable network, so it can exclude anybody it wants to. So ruled the Nevada Supreme Court less than one hour before the debate began. On the plus side, the debate was not aired on NBC in Nevada because the local anchors said that the ruling meant that it could only be broadcast on cable. What a great loophole for networks to avoid their duty to serve the public interest. Those NBC lawyers really earned their pay last night.

I'm sorry, Dennis. I sent e-mails, I left messages, but none of it helped. I hope you keep fighting anyway. Hearing your message gives hope to many hope-starved citizens.

I was TRULY disappointed in Keith's total dismissal of Dennis Kucinich last night on Countdown. I don't know if I can stomach watching anything since I'm so disillusioned by Keith's disregard for the 1st Amendment and fairness to all viable candidates. He's apparently just like all the rest, except he doesn't mind taking on the Shrub in Chief from time to time. Too bad. I thought he was one of the good guys (as good as they get in the MSM these days).

By now, we all know that Microsoft NBC Universal appealed the case. Nevada Supreme Court Jurors ruled the First Amendment Rights of qualified Presidential hopeful, Dennis Kucinich, were less important than those of a cable news network. The true Progressive did not appear on stage with the top tier aspirants.

Americans also learned, the Federal Communication Commission rules do not apply to cable broadcasters. These networks need not serve the public interest.

With thanks to the "We Bring Good Things To Life" conglomerate, there was little energy in the MSNBC Las Vegas Presidential Candidate Debate. Viewers were subjected to theatre of the absurd. As bizarre as the performances might have been, citizens were afforded an unexpected opportunity. Americans could easily see, that while three candidates graced the stage, only a single vision emerged.

Hillary Clinton, John Edwards, and Barack Obama were more than cordial. On the issues, the candidates agreed. Only their styles varied.
