Time for Reform: 20-Year-Old Intern Easily Forms Offshore Tax Haven

Bloomberg News this morning reports that U.S. Trade Representative Ron Kirk gave a speech yesterday to the U.S. Chamber of Commerce "saying he hopes Congress will approve stalled trade agreements with Panama, Colombia and South Korea within the next year." The good news is that Kirk also  noted that Bush-written trade policies are "really a tough sell in this environment."

They certainly should be - our lobbyist-written trade policies have significantly contributed to the economic collapse, hollowing out America's good-paying job base for years. Indeed, just yesterday, we see what that means: As the government bolsters domestic automakers, our rigged trade/international economic policies may undermine those efforts by allowing taxpayer cash to subsidize more job outsourcing.

The good news out of Kirk's speech was the fact that he "said negotiators in his office are working 'furiously' on labor and tax issues with Panama." At a time of massive budget deficits, that's an important step - especially when you consider how easy it currently is to hide tax income in a tax haven like Panama. Check out this video from Global Trade Watch - notice that the organization's intern is able to quickly set up a shell corporation to hide tax revenues:

It's important to keep up the pressure on the Obama administration to substantially change the Panama, South Korea and Colombia trade agreements. It's fairly clear that the progressive trade policy changes Obama promised will not come unless that pressure is intense and constant. But if it is intense and constant, I'm increasingly encouraged we can begin moving this seemingly immovable debate forward.

Foreign Profits Should not be Taxed by the U.S.

When a company sets up shop in another country that company has to create a company in that country and pay taxes on its profits to that country.

To then have to pay taxes to the U.S. as well when the U.S. was not involved is just plain theft.

Illegal to Do Biz Offshore? Follow the Law!

As I read the U.S. law, a U.S. Citizen can legally set up a foreign corporation. However, a U.S. citizen must report all income from foreign sources to the IRS and report ownership in, both direct and indirect as it relates to control of a corporation, to the USA Federal Government along with reporting any foreign financial accounts to FINCEN, the wing of the U.S. Treasury that monitors U.S. citizens in financial transactions.

The problem comes when U.S. Citizens break their own laws by not properly reporting their interest in foreign corporations and the reporting of their foreign source income to the IRS.

Get the facts. Start with reading the laws on reporting taxes at www.irs.gov and checking out what a U.S. Citizen must do to properly report as it relates to control and interests in foreign corporations so that the law is followed, respected, and honored.

Do business smartly, do NOT break the law!

As for the Panamanian in the video, it appears that he's doing a good job and within the law of his country.

Full Steam Ahead on the Bush Trade Agenda?

Candidate Obama stated repeatedly that he believed NAFTA had done more to hurt than help the U.S. economy, and that if elected president he would quickly move to renegotiate NAFTA and similar trade agreements on a number of different fronts. Those promises are a major reason why he's president and Clinton is Secretary of State.

Since getting into office, the Obama administration has indicated that it has no intention to renegotiate NAFTA and that it, in fact, plans to move full-steam ahead with Bush-negotiated, NAFTA-style Panama, Colombia and Korea Free Trade Agreements. These are trade deals negotiated and signed by President Bush, but that he was never able to get through Congress. The idea that President Obama and the Democrats would pick up these stalled Bush NAFTA-extensions and champion them is outrageous on so many fronts.

As Congresswoman Louise Slaughter (D), Chair of the House Rules Committee said, "I'm getting really pissed off. Obama's got to get a hell of a lot of stuff up through here [Congress], and to start by bumming out about half of us [ie, the fair trade Democrats] doesn't strike me as a wise move."
