Is Dick Cheney Trying to Create His Own 4th Branch of Government?

The Vice President of the United States, Dick Cheney, is trying to create a new legal status for himself. This latest development raises serious new questions about Cheney -- and who, if anyone, has authority over his actions. In Cheney's mind, it seems no one does.

CREW just issued this news release asking these new questions that need to be answered about Dick Cheney:

In light of new revelations that Vice President Cheney is claiming that his office is not subject to an executive order governing the handling of classified information because as president of the Senate he has both legislative and executive duties, CREW asks if Vice President Cheney is attempting to create a fourth branch of the government?

Under his argument, if Mr. Cheney is not subject to executive branch security requirements, surely he must be subject to Senate rules.

To safeguard sensitive information, in 1987 the Senate created the Office of Senate Security, which is part of the Secretary of the Senate. The Security Office's standards, procedures and requirements are set out in the Senate Security Manual, which is binding on all employees of the Senate.

So, if Mr. Cheney is a member of the Senate, he must adhere to the following:

* a requirement that any of his staff needing access to classified information undergo a security clearance and complete written non-disclosure agreements;

* physical security requirements, that the Security Office is empowered to implement, including any necessary inspections; and

* investigations of suspected security violations by employees, such as the security violation committed by Scooter Libby when he unlawfully disclosed the identity of Valerie Plame Wilson, then a covert CIA operative.
In addition, Mr. Cheney and his staff would be subject to investigation by the Senate Ethics Committee, which has the responsibility to investigate allegations of improper conduct which may reflect upon the Senate, including violations of law and the rules and regulations of the Senate.

Melanie Sloan, executive director of Citizens for Responsibility and Ethics in Washington said Mr. Cheney's arguments raise new questions:

Since there is no fourth branch of government to which Mr. Cheney could belong, by claiming the Office of the Vice President is within the legislative branch does Mr. Cheney agree that he is subject to Senate security procedures?

Mr. Cheney's office refused to describe its 2003 classification activities to the National Archives and Record Administration (NARA), but is he now willing to describe them to the Senate Security Office?

If Mr. Cheney does not believe that NARA's Information Security Oversight Office can conduct on-sight inspection of Mr. Cheney's office to see how sensitive material is handled, does he agree that the Senate Security Office can conduct such an inspection?

We'd really like some answers.

Oh, for the Al Franken show!

My husband and I would love to hear Al talk about this on his (alas, gone) radio show. This morning we said how much we would love to hear Melanie Sloan discuss this on his show. And we thought, maybe he would bring in some Constitutional lawyers, too. Or Willie Brown could comment on the Will and Willie show (alas, gone too), and Will Durst would make some jokes and more incisive comments. So it is great to see CREW's response--we'd really like some answers too, and maybe Will will write a column on Cheney, the execulative hybrid. 200+ years and I believe this is the first time a vice-president has claimed not to be in the Executive Branch. I had no idea he spent so much time in the Senate. How did Gore and George H. W. Bush feel--were they in the Executive or Legislative Branch? Or is this news to them too?

Cheney belongs to the cafeteria branch

Cheney belongs to whatever branch suits his purposes at any given moment. If he needs to tap into executive privilage, he's part of the executive branch. If executive branch members are subject NARA oversight, than he's part of the legislative branch. And he can decide which is which whenever he wants, and if anyone says anything about it, he can either abolish their department, or just shoot them in the face. I only hope, sooner rather than later, he has to explain this to a grand jury.

More and more the evidence seems to suggest that these thugs are not planning to vacate their offices in January '09. I think they intend to remain in power.

Does anyone else remember toward the end of "All The President's Men",down in the garage, Bernstein found out that the corruption extended to the Justice Dept., Congress, FBI, CIA and the White House. Everybody. The look on his face. It's a miracle that Bradley and Katherine Graham had the guts to go with the story. Woodward and Bernstein scared to death. Bush, Cheney & Co.- any day now. headed by none other than Iran-Contra (and probably other) operations Adm.Poindexter? Remember the insane symbol for the office (a weird, satanic-like masonic "eye" over a pyramid)? Look it up. This is their goal. Remember "it is not about gun control, it is about control" (this applies to all of our civil rights, not just right to own weapons by the way.)

A PETITION FOR A REDRESS OF GRIEVANCES RELATED TO THE CONDUCT OF VICE PRESIDENT CHENEY IN REGARD TO THE UNCONSTITUTIONAL CONDUCT OF ROGUE INTELLIGENCE OPERATIONS AND SECRET COMMUNICATIONS WITH FOREIGN GOVERNMENTS

TO THE CONGRESS OF THE UNITED STATES in care of Congressman Henry Waxman, Chairman of the House Oversight and Government Reform Committee.

WHEREAS, Vice President Richard B. Cheney claims the un-Constitutional power to conduct secret communications with foreign governments, corporate interests, and other entities regarding the business of the People of United States of America;

AND WHEREAS, he has refused to disclose any information about such communications to The Information Security Oversight Office, the a unit of the National Archives that supervises the handling of classified information on behalf of the People of the United States;

AND WHEREAS, he has sought to shut down The Information Security Oversight Office;

AND WHEREAS, he claims to operate independently from the Executive Branch of our government;

Here is the embodiment of least 50% of America’s current malaise. A pertinacious and agelast veep whose office runs parallel U.S. policy. While the buck should stop in the oval office Cheney remains the single most dangerous individual in the world. The next 18 months can’t pass fast enough.

that as soon as we get close enough in time to the 2008 election, "someone" will asassinate W and dick will take over and declare martial law, cancelling the election. i thought it might happen last time, but i guess they wanted a little more "legitimate" time (a-HEM).

While I am no American historian, I am reasonably well acquainted with 20th century politics. It seems to me that no other rogue administration (Nixon/Watergate; Reagan/Contragate) has made a systematic effort to seize power.Bush, Cheney, Gonzalez put themselves above the law. The others were merely opportunists who tried to get away with a few things. The Bush Cheney regime is consolidating power. They are systematically destroying our republican form of government. Mussolini and Hitler used different techniques (party thuggery, omni present police brutality) to achieve the same result: a dictatorial executive that is unchecked by intimidated parliaments and courts.

I agree with aislinnluv, dick will do what ever it takes to remain president(vice), I am not sure he wont let bush stay on, he can use bush as a fall guy and that is worth some thing. I believe with all my heart that any man-woman can see that their will not be a election in 08. all the news media are getting us ready for the news of no election rush, sean & bill have been working on this for 6 years now, and most of the people with I Q of 70 or less are ready they have to work harder for the people above 70, they have all the republicans
ready and eager to get it done. the people who call in to rush,sean & bill make me sick, rush and all make them think if you are not a bush man you are not worth any thing they think we are just dumb ass arabs, and they do think the arabs are dumb. the people of America had better wise up before it is to late. Cheney and others in the Admin aren't looking for immediate victory; they are in this for the long haul. These reactionaries and their antecedents have been fighting the New Deal for more than 70 years and they're just now getting the majority in Congress to effectively repeal much of its permanancy: Social Security, National Labor Relations Board, Etc. As they "privatize" they take us back to the change of the century - 1898 >> 1902. This is when their ancestors made their fortunes, and adventure in enterprise ruled the day.

Get these people out of office, even if you have to hold your nose voting for a pro-war Democrat or a pro-choice Republican, get these reactionaries out of the state house, white house and the Congress. We also have to get them our of the courts and that will be slightly more difficult. If we'd treated them (while the progressives of the nation controlled government) the way they've treated us while they've been in control --- they'd have never made it to positions of power. Strike back --- keep them out. Without choice there is no democracy.

Contacting Congressional Reps can and does have effect:

Current status:
Seven Reps have signed on.
The Judiciary Committee has not yet scheduled a hearing on the resolution. Absent a positive referral from the Judiciary Committee, the only way the resolution can reach the floor of the House is with the approval of the Speaker of the House, Nancy Pelosi.

Estate in this sense was first used in the 14th century and means 'a major political or social group or class'. People dissatisfied with mainstream journalism maintain that we need a fifth estate because the fourth estate is abdicating its responsibility as a watchdog against government and failing to provide balanced coverage. In this sense, the fifth estate is some sort of alternative newspaper.

Alternative newspapers these days tend to appear online, and that's the other current meaning of fifth estate. It can mean any sort of electronic medium. As someone wrote in a chat room, "The fourth estate is being watched by the fifth estate."

How long are the Lilly livered representatives going to take this crap. Dick Cheney is one man who has no real power. He is vice president with no executive powers, unless the president gets ill or dead. Impeachment must start in the House of Representatives and Nancy, keep your mouth shut and let the willing do what has to be done. Support the Representatives willing to lay their lives on the line for our country, for I fear it has come that far. Dick has gone round the bend . Maybe some of those high powered drugs he has been on for years finally short circuited his brain. They effect the neurotransmitters in the brain you know

By the way, what is Cheney’s Borg Identity? FUtus of Borg. In Borg lore FUtus is often depicted as offering the Borg symbol of unity to the masses.

Who else in the administration has a Borg identity? Why there’s Alberto Gonzalez whose Borg identity is Refutus which means: It’s not my fault.

What about Bush himself? He is known as BigDoofus of Borg. Well actually BigDoofus of half wit because the Borg refused to give Bush a Borg identity. Even the Borg failed to find a brain in that head. Since they could find no brain, the Borg implants failed to take root in BigDoofus of halfwit. Nevertheless, the Borg in an uncharacteristic show of compassion allowed Bush to glue “falsies”—fake Borg implants onto his person after he let it be known that he thought Borg implants “looked cool.”


Note there are other Borg identities out there.


Rush is known as BigGlutus of Borg.

Ann is known as ShrillShrewtus of Borg.


All of those senators who are crying over their recent losses in the immigration battles are collectively known as BooHootus of Borg.
